Mission and Program Overview

Mission

The public defender association advances social and racial equity and community health through reform of the criminal justice system. Grounding reform in a public health and safety framework, pda develops new strategies and implements models that improve on conventional responses to crime and public order issues. In collaboration with community and government partners, we use policy advocacy, organizing, litigation, and public education to achieve our goals.

Management reviews the 990 and reconciles to the audited and board approved financial statements. A copy is e-mailed to the board president and chair of the audit committee who also review the return prior to its being filed.

Form 990, Part VI, Section B, line 12C

Board Members and management review and sign a detailed conflict of interest form each year that covers both legal and financial conflicts. Board members do identify emerging potential conflicts and, following the policy, either declare and recuse themselves, or, when the conflict is more fundamental, resign from the Board.

Form 990, Part VI, Section B, line 15A

The Board set a wage scale for the Director upon hire which was discussed in Executive Session and took into consideration the Director's desire to be paid at lower than some market comparables in order to more readily sustain funding for the organization's programs. Other employee wages were set on scales with reference to King County salaries organization staff would have been paid had they accepted County job offers, and approved by the Board. The Board determines COLA annually.

Financial Statement Notes

Part IV, Line 2B:

PDA maintains a separate bank account to hold funds received on behalf of clients in trust until matters are settled at the direction of the client or the court. Any earnings revert to the state through the Interest on Lawyers Trust Accounts (IOLTA) program. During 2015, no transactions occurred and the balance averaged less than $1000.

Part X, Line 2:

Public Defender Association is a non-profit organization exempt from Federal income tax under Section 501(c)(3) of the Internal Revenue Code. The Association's income tax filings are subject to examination by various taxing authorities. The Organization believes that it has appropriate support for any tax positions taken and, as such, does not have any uncertain tax positions that are material to the financial statements.
