Mission and Program Overview

Mission

The organization is dedicated to serving texas prosecutors and their staffs, as well as attorneys in government representation. Tdcaa serves the people who work in the district and county attorneys offices around the state by: 1) producing comprehensive continuing legal education courses for prosecutors, their investigators, and personnel; 2) providing technical assistance to the prosecution community and related criminal justice agencies; and 3) serving as a liaison between prosecutors and other organizations in the day to day adminstration of criminal justice.

Eligibility to vote for officers, directors, and honorary members shall be restricted to district attorneys, criminal district attorneys, and county attorneys who are regular members in good standing.

Each regular member in good standing of the association present at the annual meeting or any special meeting shall be entitled to one vote on each matter submitted to a vote of the members except the election of officers, directors, and honorary members.

Additional Explanations

FORM 990, PART XII, LINE 1:

The previous year form 990 was marked cash basis. However, the organization's books are kept on modified cash basis. Modified cash basis is also the basis of the audited financial statements.

FORM 990, LINE I:

Previous forms 990 have erroneously marked that the organization's tax-exempt status was granted under section 501(c)(3). However, in actuality, the organization is tax-exempt under section 501(c)(6).

FORM 990, PART V, LINE 6B:

The organization only solicits contributions in the form of government grants from state of texas governmental entities. Therefore, the organization has not provided any statement regarding deductibility to the state agencies from which the grants originated.

FORM 990, PART XI, LINE 8:

During the organization's tax year ending 8/31/14, it was determined that the organization had not previously reported certain bank accounts and real property owned by the organization, as well as the related debt on the property. Therefore, a prior period adjustment has been reported on part xi to reflect the proper inclusion of those items on part x. The audit of the organization's financial statements for the year ended august 31, 2015 is in process and will be completed after the filing of this form 990. Therefore all questions and responses have been recorded as if the audit was complete.

Financial Statement Notes

PART X, LINE 2:

The most significant tax positions of tdcaa is its assertion that it is exempt from income taxes and their determinations of whether any amounts are subject to unrelated business income tax (ubit). Tdcaa leases office space in tdcaa's debt-financed building. The internal revenue service (irs) considers this "business income" unrelated to tdcaa's tax exempt status. A portion of the profit from these activities is subject to federal income taxes. However, tdcaa incurred net losses from these activities during the year ended august 31, 2015. Thus no provision has be included in these fianancial statements for any federal income tax liability that may result from this revenue as of august 31, 2015. All significant tax positions have been considered by management and it has determined that is more likely than not that all tax positions would be sustained upon examination by taxing authorities.

IN ADDITION, TDCAA HOSTS REGIONAL TRAINING, IN-HOUSE TRAINING, AND ONLINE TRAINING. IN 2015, TDCAA DELIVERED OVER 67,000 TRAINING HOURS TO ATTORNEYS, INVESTIGATORS, KEY PERSONNEL AND ALLIED PROFESSIONALS.

PROSECUTORS OFTEN NEED TECHNICAL ASSISTANCE IN THE PERFORMANCE OF THEIR LEGAL DUTIES. THE TDCAA STAFF MONITORS LEGISLATION AND COURT DECISIONS SO THAT IT CAN IMMEDIATELY RELAY CHANGES IN THE LAW AND OTHER INFORMATION TO PROSECUTORS. THE ASSOCIATION ALSO RESEARCHES LEGAL ISSUES AND OFFERS TECHNICAL ADVICE TO MEMBERS UPON REQUEST.
