Mission and Program Overview

Mission

The organization is dedicated to serving texas prosecutors and their staffs, as well as attorneys in government representation. Tdcaa serves the people who work in the district and county attorneys offices around the state by: 1) producing comprehensive continuing legal education courses for prosecutors, their investigators, and personnel; 2) providing technical assistance to the prosecution community and related criminal justice agencies; and 3) serving as a liaison between prosecutors and other organizations in the day to day adminstration of criminal justice.

Eligibility to vote for officers, directors, and honorary members shall be restricted to district attorneys, criminal district attorneys, and county attorneys who are regular members in good standing.

Each regular member in good standing of the association present at the annual meeting or any special meeting shall be entitled to one vote on each matter submitted to a vote of the members except the election of officers, directors, and honorary members.

The executive director and director of operations reviewed the return with the preparing cpa. After review, the form 990 was provided to all board members prior to filing with the irs.

The confilict of interest policy and form is distributed before the december board meeting. The executive director is charged with compiling all of the board member forms. Once those are compiled, they are reviewed by the executive director and the tdcaa board of directors for potential conflicts of interest that would require board member recusal.

The board of directors evaluates the executive director's salary by examining ceo salaries of comparable non-profit corporations using an online resource, and comparing with all napc directors of prosecutor associations around the country. The organization only solicits contributions in the form of government grants from state of texas governmental entities. Therefore, the organization has not provided any statement regarding deductibility to the state agencies from which the grants originated.

The audit of the organization's financial statements for the year ended august 31, 2016 is in process and will be completed after the filing of this form 990. Therefore all questions and responses have been recorded as if the audit was complete.

Financial Statement Notes

PART X, LINE 2:

The most significant tax positions of tdcaa is its assertion that it is exempt from income taxes and their determinations of whether any amounts are subject to unrelated business income tax (ubit). Tdcaa leases office space in tdcaa's debt-financed building. The internal revenue service (irs) considers this "business income" unrelated to tdcaa's tax exempt status. A portion of the profit from these activities is subject to federal income taxes. Tdcaa had revenue in excess of expenses for the year ended august 31, 2016 and, thus, utilized a net operating loss carryover from a prior year. However, tdcaa incurred a net loss from these activities during the year ended august 31, 2015. All significant tax positions have been considered by management and it has determined that is more likely than not that all tax positions would be sustained upon examination by taxing authorities.

PROSECUTORS OFTEN NEED TECHNICAL ASSISTANCE IN THE PERFORMANCE OF THEIR LEGAL DUTIES. THE TDCAA STAFF MONITORS LEGISLATION AND COURT DECISIONS SO THAT IT CAN IMMEDIATELY RELAY CHANGES IN THE LAW AND OTHER INFORMATION TO PROSECUTORS.
