To promote the environmental integrity of the french creek watershed, and to advocate the protection of its natural resources for the aesthetic, ecological, recreational, and economic benefit of all, through the coordination of land protection, education, and research.

On january 1, 2014, the conservancy elected to change its method of accounting to the modified cash basis method, whereas in all prior years, the accrual method was used. Also in 2014 the conservancy changed its method of accounting for conservation easements from capitalizing them as assets to expensing them when acquired.

Part II, Line 5:

The french creek valley conservancy written policy regarding the periodic monitoring, inspection, violations, and enforcement of the conservation easements it holds is governed by our easement enforcement policy. The long term effectiveness of conservation easements in protecting valuable lands depends on the french creek valley conservancy's ability to enforce the terms of the easements. Strong enforcement builds public confidence in easements as a land proetction tool. By swiftly responding to violations, whether actual or porential, the fcvc will preserve the legal right to enforce the easements it holds. In order to accept tax deductible gifts and qualify for tax exempt status, irs regulations require that easement-accepting organizations commit to upholding the terms of an easement and maintaining the financial capability to enforce the restrictions. All conservation easements held will be monitored at least once annually.

Part II, Line 9:

Under the modified cash basis of accounting donations of land and land interests are not recorded. The conservancy records land and land interests at cost when purchased and the related cost is then expensed.

Part V, Line 4:

The funds are held for the stewardship of the easements and fee simple properties in perpetuity.

Part X, Line 2:

The conservancy qualifies as an exempt organization under section 501(c)(3) of the internal revenue code and has no provision for federal or state income taxes. Accordingly, income tax expense is limited to activities that are deemed by the internal revenue service to be unrelated to their exempt purpose. Interest and penalites related to income tax reporting are recognized when incurred and are included in administrative expenses in the statement of support and revenues, expenses and changes in net assets - modified cash basis. Management has determined the conservancy had no activities subject to unrelated business income tax (ubit) during the year ended december 31, 2016. The conservancy has not been subject to any income tax penalties or interest for all open tax years. The open tax periods for the conservancy are 2013, 2014, 2015 and 2016.

BY SWIFTLY RESPONDING TO VIOLATIONS, WHETHER ACTUAL OR PORENTIAL, THE FCVC WILL PRESERVE THE LEGAL RIGHT TO ENFORCE THE EASEMENTS IT HOLDS. IN ORDER TO ACCEPT TAX DEDUCTIBLE GIFTS AND QUALIFY FOR TAX EXEMPT STATUS, IRS REGULATIONS REQUIRE THAT EASEMENT-ACCEPTING ORGANIZATIONS COMMIT TO UPHOLDING THE TERMS OF AN EASEMENT AND MAINTAINING THE FINANCIAL CAPABILITY TO ENFORCE THE RESTRICTIONS.
