Drnm staff provided input into an investigation by the department of justice regarding use of excessive and often lethal force against persons with mental illness by the albuquerque police department and served on a city-county task force that studied service gaps and made recommendations for ways to better serve persons with mental illness and reduce their involvement with police.”
“With disabilities who need long-term services to navigate the system and access the services they need and brought to the attention of state officials and legislators that the new system was not serving as many individuals as intended, was not meeting federal requirements for exempting persons with disabilities from mandatory enrollment in an alternative benefit plan rather than regular medicaid, and was discriminating against persons with the most severe disabilities by limiting the amount of services they could receive. Drnm provided trainings statewide on the new opportunities for health care coverage through medicaid expansion and the health insurance exchange. Drnm convinced two state universities to expand their services to students with disabilities and not require such students to apply for assistance from the state vocational rehabilitation agencies.”

DRNM FILED A LAWSUIT THIS YEAR AGAINST STATE AGENCIES CHALLENGING ARBITRARY AND INAPPROPRIATE DENIALS OF SERVICE, AND THE FAILURE TO PROVIDE OPPORTUNITIES TO CHALLENGE THOSE DENIALS. A HEARING WAS HELD IN FEDERAL COURT, AND WE ARE WAITING FOR A RULING ON THE CASE. DRNM WAS THE LEAD AGENCY THIS YEAR IN SEEKING ADDITIONAL FUNDING THAT WOULD REDUCE THE LENGTHY WAITING LIST FOR COMMUNITY-BASED WAIVER SERVICES. WE HELPED FAMILIES REGAIN BEHAVIORAL HEALTH SERVICES FOR SCHOOL CHILDREN WITH BEHAVIOR DISORDERS AFTER A DISRUPTION IN THE STATEWIDE SERVICE SYSTEM AND SECURED COMPENSATORY SPECIAL EDUCATION SERVICES FOR CHILDREN WHO HAD BEEN DENIED THOSE SERVICES BY THEIR PUBLIC SCHOOL DISTRICT. PROBLEMS ADDRESSED IN THESE CASES INCLUDED ALLEGED ABUSE, NEGLECT (INCLUDING LACK OF ADEQUATE OR APPROPRIATE TREATMENT SERVICES), OR OTHER RIGHTS VIOLATIONS. DRNM CONDUCTED AT LEAST 53 TRAININGS AND OUTREACH SESSIONS IN MENTAL HEALTH FACILITIES AROUND THE STATE. WE CONTINUED TO ASSIST INDIVIDUALS WHO EXPERIENCED DISRUPTIONS IN SERVICES DUE TO THE STATE'S UNPRECEDENTED CLOSURE OF THE ITS LARGEST BEHAVIORAL HEALTH PROVIDERS AND THEIR REPLACEMENT BY OUT-OF-STATE PROVIDERS. DRNM STAFF CONDUCTED AN IN-DEPTH INVESTIGATION OF THE DEATHS OF TWO ADULTS AT AN UNLICENSED BOARDING HOME WHICH CONFIRMED THAT THEY DIED OF CARBON MONOXIDE POISONING DUE TO A PROPANE HEATER THAT HAD BEEN IMPROPERLY INSTALLED AND REVEALED THAT THERE HAD BEEN NO OVERSIGHT OR MONITORING OF THE BOARDING HOME--WHICH WAS A SHED NOT INTENDED TO BE USED FOR HOUSING--BY ANY STATE OR LOCAL AGENCY OR OFFICIALS. DRNM STAFF PROVIDED INPUT INTO AN INVESTIGATION BY THE DEPARTMENT OF JUSTICE REGARDING USE OF EXCESSIVE AND OFTEN LETHAL FORCE AGAINST PERSONS WITH MENTAL ILLNESS BY THE ALBUQUERQUE POLICE DEPARTMENT AND SERVED ON A CITY-COUNTY TASK FORCE THAT STUDIED SERVICE GAPS AND MADE RECOMMENDATIONS FOR WAYS TO BETTER SERVE PERSONS WITH MENTAL ILLNESS AND REDUCE THEIR INVOLVEMENT WITH POLICE. |

DRNM PROVIDED INFORMATION AND TRAINING ON EXPANDED OPPORTUNITIES TO ACCESS AND SELF- DIRECT LONG-TERM SERVICES UNDER THE STATE'S NEW MEDICAID PROGRAM, "CENTENNIAL CARE." WE ADVOCATED FOR THE STATE TO HELP ELDERS AND PEOPLE WITH DISABILITIES WHO NEED LONG-TERM SERVICES TO NAVIGATE THE SYSTEM AND ACCESS THE SERVICES THEY NEED AND BROUGHT TO THE ATTENTION OF STATE OFFICIALS AND LEGISLATORS THAT THE NEW SYSTEM WAS NOT SERVING AS MANY INDIVIDUALS AS INTENDED, WAS NOT MEETING FEDERAL REQUIREMENTS FOR EXEMPTING PERSONS WITH DISABILITIES FROM MANDATORY ENROLLMENT IN AN ALTERNATIVE BENEFIT PLAN RATHER THAN REGULAR MEDICAID, AND WAS DISCRIMINATING AGAINST PERSONS WITH THE MOST SEVERE DISABILITIES BY LIMITING THE AMOUNT OF SERVICES THEY COULD RECEIVE. DRNM PROVIDED TRAININGS STATEWIDE ON THE NEW OPPORTUNITIES FOR HEALTH CARE COVERAGE THROUGH MEDICAID EXPANSION AND THE HEALTH INSURANCE EXCHANGE. DRNM CONVINCED TWO STATE UNIVERSITIES TO EXPAND THEIR SERVICES TO STUDENTS WITH DISABILITIES AND NOT REQUIRE SUCH STUDENTS TO APPLY FOR ASSISTANCE FROM THE STATE VOCATIONAL REHABILITATION AGENCIES. |
