The modular building institute is the only international non-profit trade association serving non-residential modular construction. The organization represents hundreds of companies in countries around the world involved in the manufacturing and distribution of commercial factory-built structures. As a lead organization for education in the industry, the organization encourages the public to rethink modular. The organization provides services to and promotes the business of manufacturers and marketers of non-residential factory-built structures through the education of policy makers regarding building codes and by holding conventions and meetings to educate and improve the industry.

Modular building institute has a trade association management agreement with hardiman-williams, llc for the provision of management services. Hardiman-williams, llc is owned and managed by thomas hardiman, the executive director of modular building institute, and steven williams, the operations director.

Vii. Membership 1. Classes of membership a) regular: manufacturers and dealers of code compliant relocatable buildings as well as permanent modular construction contractors. B) associate: companies supplying building components, services, and financing to companies in the modular construction industry. C) individual: students, professors, and individuals who are not employees of companies engaged in modular construction.

Form 990, Part VI, Section A, Line 7A

The nominating committee will petition qualified member companies of the association to solicit representatives to serve on the board of directors via electronic call for nominations to all members in the fall of each year, as well as by any other means necessary to ensure an adequate candidate pool. The committee will consider the segment of industry the candidate represents, experience in the industry and commitment to the association's overall objectives. The nominating committee will prepare a slate of directors, including officers, to present to the board of directors for approval. Once approved by the board of directors, the slate will be presented to the membership at the annual business meeting of the association for approval. Terms will commence immediately upon completion of the business meeting. The association's board members will be limited to two consecutive full terms, unless selected to serve on the executive committee by the board. Candidates should be reviewed with the following criteria in mind, understanding that exceptions may be made from time to time. A) before a candidate can be considered, that individual must be an employee of a member company in good standing. The member company must have been in good standing with the association for two years prior to the candidate's consideration. The individual should have at least five (5) years of industry related experience and must be granted full authority from their respective companies to vote on industry issues, and must have the support from their respective companies (financial and otherwise) that allows attendance to all regional, board and annual meetings. B) no more than one (1) individual representative from a member company may serve on the board at the same time. C) selection of candidates should take into consideration the geographical location, size and type of the member company when determining board openings. The association shall endeavor to have a representative mix of membership serving on the board of directors. D) candidate must have at least one year of service to the association prior to consideration. Service includes serving on an mbi committee, the educational foundation, or volunteering to present at the association's training conferences.

Each member firm or corporation shall appoint and certify to the association a person to be its representative in the association and who shall represent, vote, and act for the member in all affairs of the association. Each member firm or corporation is entitled to one vote on such occasions.

Form 990 is then made available electronically to all members of the governing board for review and any questions are answered at the annual board meeting at least one week prior to filing. THE COMMITTEE WILL MAKE RECOMMENDATIONS TO THE BOARD FOR POSITIONS THE ASSOCIATION WILL TAKE ON VARIOUS LEGISLATIVE OR REGULATORY ISSUES. THOSE RECOMMENDATIONS INCLUDE: 1) OPPOSE; 2) SUPPORT; 3) SUPPORT WITH AMENDMENTS; 4) SUPPORT CONTINGENT UPON; 5) NO POSITION; OR 6) NO OBJECTION. THESE POSITIONS WILL BE COMMUNICATED TO VARIOUS STAKEHOLDERS AND POLICYMAKERS. FUNDING OF GOVERNMENT AFFAIRS ACTIVITIES - IT SHALL BE THE RESPONSIBILITY OF THE GOVERNMENT AFFAIRS COMMITTEE TO DETERMINE WHAT, IF ANY, LEVEL OF FUNDING TO RECOMMEND FOR SPECIFIC ISSUES. THE LEVEL OF FUNDING MUST BE WITHIN THE APPROVED BUDGET AND WILL BE BASED ON THE FOLLOWING CRITERIA: 1) ASSESSMENT OF THE SITUATION AND NEED FOR HIRED REPRESENTATION INCLUDING LOBBYISTS OR ATTORNEYS, AND COST VS. EMPLOYING A GRASSROOTS APPROACH. 2) WHICH COMPANIES/MEMBERSHIP TYPES WILL BE POTENTIALLY IMPACTED AND THE STAKEHOLDERS. 3) WHICH COMPANIES HAVE FUNDED THE SEALS ACCOUNT HISTORICALLY AND YTD. 4) THE POTENTIAL FOR THE ISSUE TO HAVE IMPACT BEYOND ITS CURRENT JURISDICTION. 5) AVAILABILITY OF FUNDS 6) LIKELIHOOD OF ADDITIONAL ISSUES TO FUND DURING BUDGET YEAR. THE COMMITTEE SHALL HAVE AUTHORITY TO RECOMMEND WHETHER OR NOT TO HIRE PROFESSIONAL ASSISTANCE AND THE PERCENTAGE OF COMMITMENT THE ASSOCIATION WILL FUND, FROM 0 TO 100%, WITHIN PRE-APPROVED GOVERNMENT AFFAIRS BUDGET GUIDELINES. THE ASSOCIATION'S STAFF WILL CONTACT STAKEHOLDERS WITH COMMITTEE RECOMMENDATION AND SEEK FIRM COMMITMENTS FOR ANY SHORTFALL IN FUNDING, AND COMMUNICATE THE FUNDING PLAN BACK TO THE GOVERNMENT AFFAIRS COMMITTEE PRIOR TO ENGAGEMENT. THE PLAN WILL BE COMMUNICATED TO THE MBI BOARD AT THE NEXT SCHEDULED MEETING.
