A RECENT FAC LAWSUIT AGAINST THE SAN DIEGO POLICE DEPARTMENT AND THE FBI RESULTED IN RELEASE OF HUNDREDS OF RECORDS ABOUT A SECRET CELL PHONE SURVEILLANCE DEVICE CALLED THE "STINGRAY." THE RECORDS SHOWED POLICE HAD FAILED TO IDENTIFY THE STINGRAY WHEN OBTAINING SEARCH WARRANTS; THEY HAD ALSO FAILED TO NOTIFY DEFENSE COUNSEL ABOUT EVIDENCE GENERATED BY THE STINGRAY. FAC ALSO FORCED SONOMA COUNTY TO MAKE PUBLIC CONTRACTS WITH PROMOTERS OF THE SUPER BOWL DESPITE A CONFIDENTIALITY CLAUSE COMMITTING THE COUNTY TO KEEP THE CONTRACTS SECRET. THE COUNTY HAD CLAIMED, IN DENYING ACCESS, THAT THE RECORDS WERE FULL OF TRADE SECRETS. HOWEVER, ONCE THE DOCUMENTS WERE OPENED AS A RESULT OF THE LAWSUIT, IT WAS APPARENT THAT THEY CONTAINED NO TRADE SECRETS AT ALL.FAC CONTINUED ITS LEGAL BATTLE WITH THE STATE BAR TO COMPEL RELEASE OF DATA RELEVANT TO ACADEMIC RESEARCH ON USE OF RACIAL PREFERENCES IN UNIVERSITY ADMISSIONS POLICIES.
