Part III

OTHER PROGRAM SERVICES INCLUDES THE FOLLOWING: 1) FACILITIES RENTAL - INCLUDES THE RENTAL OF THE POOL, GYM, THEATRE, STUDIOS AND ASTROTURF FIELD. 2)THE ASPHALT GREEN BATTERY PARK CITY ("AGBPC") FACILITY formally began its operations in June 2013 under an amended Management-Services Agreement (the "March 2013 agreement"). Under this March 2013 agreement, BATTERY PARK CITY AUTHORITY ("BPCA") leased to Asphalt Green the Premises as defined in the agreement. The Premises are leased for a term of approximately ten years, which started on May 1, 2013 and will end in June 2023, or on the last day of any extended term pursuant to the lease agreement. Rental payments will be calculated on a fee structure that is based on a percentage of AGPBC's operating revenue and for the fiscal year beginning July 1, 2018 and ending June 30, 2019. The estimated future minimum rental payments, through fiscal-year 2023, are approximately $1,213,000. In addition, Asphalt Green will receive $225,000 per year for operating expenses related to the Premises for the first three years of operation. For each of the fiscal-years 2016 and 2015, Asphalt Green received $146,337 and $225,000, respectively, and this rental payment revenue was reported as other income in the statements of activities. For the fiscal year 2016, the $146,337 received was the last payment due to Asphalt Green, comprised of for $225,000 less certain operating costs due to BPCA totaling $78,663.

Asphalt Green follows the provisions of the Financial Accounting Standards Board's (the "FASB") Accounting Standards Codification ("ASC") Topic 740, Income Taxes, relating to accounting and reporting for uncertainty in income taxes. For Asphalt Green, ASC Topic 740 is potentially applicable to the incurrence of unrelated business income attributable to the rental of certain facilities. However, due to its general not-for-profit status, management believes ASC Topic 740 has not had, and is not anticipated to have, a material impact on Asphalt Green's financial statements.
