The board of directors serve in a volunteer capacity.

Form 990, Page 2, Part III, Line 4A

Planning and budgeting process this year based on a settlement agreement that resolved a lawsuit we filed previously. We provided information to legislators about the number of persons on the waiting list for dd waiver services and the length of time on the waiting list before services begin, and a bill was passed by the legislature requiring the state to provide such information on an annual basis. However, the governor vetoed that bill.

Offensive reference to "idiots and insane persons." we continued to work with city and county representatives as they significantly expand services to persons with mental illness in the albuquerque area. Drnm's investigative report on restraints and excessive force, as well as peer- on-peer violence, at a children's residential treatment facility in southern new mexico ("the peak") was released this year and helped lead to the imposition of a corrective action plan by the state that has produced significant improvements at the facility. We provided information to legislators about the needs of persons with mental illness and raised concerns over provisions of a proposed bill authorizing court-ordered mental health treatment since it covered persons who are competent to make their own decisions and who are not dangerous to themselves or others and not accused of a crime. Drnm staff participated on the state supreme court's mental health rules committee, addressing the process for determining competency in criminal proceedings.

Through the state medicaid program but rarely provided. The new process reviews all available services to determine whether they would be applicable and appropriate for each participant. Drnm staff in this program also educated policymakers about the benefits of medicaid services for persons with disabilities and the favorable economic impact of medicaid eligibility expansion. More than 255,000 individuals (nearly 13% of the state's population) are newly covered due to this expansion.

ABOUT 45% OF THESE INDIVIDUALS WERE MEMBERS OF AN ETHNIC OR RACIAL MINORITY. WE PROVIDED A TOTAL OF 52 TRAINING SESSIONS AT MENTAL HEALTH FACILITIES AROUND THE STATE, INCLUDING THE BEHAVIORAL HEALTH INSTITUTE IN LAS VEGAS, NEW MEXICO, WHICH IS THE STATE'S MENTAL HEALTH HOSPITAL. THROUGH AN AMICUS BRIEF, WE PROVIDED INFORMATION TO THE STATE SUPREME COURT, WHICH DIRECTED THE COMPILATION OF A CONSTITUTIONAL AMENDMENT THAT DELETED AN ARCHAIC AND OFFENSIVE REFERENCE TO "IDIOTS AND INSANE PERSONS." WE CONTINUED TO WORK WITH CITY AND COUNTY REPRESENTATIVES AS THEY SIGNIFICANTLY EXPAND SERVICES TO PERSONS WITH MENTAL ILLNESS IN THE ALBUQUERQUE AREA. DRNM'S INVESTIGATIVE REPORT ON RESTRAINTS AND EXCESSIVE FORCE, AS WELL AS PEER- ON-PEER VIOLENCE, AT A CHILDREN'S RESIDENTIAL TREATMENT FACILITY IN SOUTHERN NEW MEXICO ("THE PEAK") WAS RELEASED THIS YEAR AND HELPED LEAD TO THE IMPOSITION OF A CORRECTIVE ACTION PLAN BY THE STATE THAT HAS PRODUCED SIGNIFICANT IMPROVEMENTS AT THE FACILITY. WE PROVIDED INFORMATION TO LEGISLATORS ABOUT THE NEEDS OF PERSONS WITH MENTAL ILLNESS AND RAISED CONCERNS OVER PROVISIONS OF A PROPOSED BILL AUTHORIZING COURT-ORDERED MENTAL HEALTH TREATMENT SINCE IT COVERED PERSONS WHO ARE COMPETENT TO MAKE THEIR OWN DECISIONS AND WHO ARE NOT DANGEROUS TO THEMSELVES OR OTHERS AND NOT ACCUSED OF A CRIME. DRNM STAFF PARTICIPATED ON THE STATE SUPREME COURT'S MENTAL HEALTH RULES COMMITTEE, ADDRESSING THE PROCESS FOR DETERMINING COMPETENCY IN CRIMINAL PROCEEDINGS.

THE PAIR PROGRAM ASSISTED 425 INDIVIDUALS WITH DISABILITIES THIS YEAR, TWO-THIRDS OF WHOM WERE FROM AN ETHNIC OR RACIAL MINORITY. MOST OF THE ISSUES RAISED IN THESE CASES WERE IN THE AREA OF SPECIAL EDUCATION OR ACCESS TO COMMUNITY SERVICES OR HEALTH CARE IN GENERAL. AS A RESULT OF PAIR ADVOCACY THIS YEAR, THE STATE BEGAN A SIGNIFICANT CHANGE TO THE WAY THAT THE NEEDS OF INDIVIDUALS WITH SEVERE DISABILITIES ARE ASSESSED. THE OLD SYSTEM FAILED TO PROVIDE MEANINGFUL ACCESS TO THE WIDE ARRAY OF SERVICES THAT WERE POTENTIALLY AVAILABLE THROUGH THE STATE MEDICAID PROGRAM BUT RARELY PROVIDED. THE NEW PROCESS REVIEWS ALL AVAILABLE SERVICES TO DETERMINE WHETHER THEY WOULD BE APPLICABLE AND APPROPRIATE FOR EACH PARTICIPANT. DRNM STAFF IN THIS PROGRAM ALSO EDUCATED POLICYMAKERS ABOUT THE BENEFITS OF MEDICAID SERVICES FOR PERSONS WITH DISABILITIES AND THE FAVORABLE ECONOMIC IMPACT OF MEDICAID ELIGIBILITY EXPANSION. MORE THAN 255,000 INDIVIDUALS (NEARLY 13% OF THE STATE'S POPULATION) ARE NEWLY COVERED DUE TO THIS EXPANSION.

THE PRINCIPAL FOCUS OF THESE EFFORTS WAS ON A BILL AUTHORIZING COURT-ORDERED INVOLUNTARY OUTPATIENT MENTAL HEALTH TREATMENT, WHICH PASSED AND WAS SIGNED INTO LAW. SOME ADDITIONAL TIME WAS SPENT ON LEGISLATION AND FUNDING TO ADDRESS THE WAITING LIST FOR DEVELOPMENTAL DISABILITIES SERVICES. THE BILL PASSED BUT WAS VETOED BY THE GOVERNOR. A VERY SMALL AMOUNT OF TIME WAS SPENT ON A BILL TO PROHIBIT SECLUSION AND RESTRAINT IN PUBLIC SCHOOLS, WHICH WAS TABLED IN THE FIRST COMMITTEE IN WHICH IT WAS HEARD. IN ADDITION, THE AGENCY PURCHASED APPROXIMATELY 25 HOURS OF CONTRACTOR TIME WHICH WAS USED IN SUPPORT OF SIMILAR ACTIVITIES RELATED TO THE MENTAL HEALTH LEGISLATION.
