IRS990/ActivityOther/Description0AS THE ECONOMIC CONDITIONS FOR BUILDING NEW COAL PLANTS DWINDLED, OUR FOCUS HAS SHIFTED TO ADDRESSING AIR POLLUTION FROM EXISTING COAL PLANTS AND ENSURING THAT UTILITIES ARE MAKING THE BEST ENERGY CHOICES FOR THEIR CUSTOMERS AND THE ENVIRONMENT. IN 2011, WE INTERVENED IN A CASE BEFORE THE PUBLIC SERVICE COMMISSION TO CHALLENGE PACIFICORP, WYOMING'S AND THE WEST'S LARGEST UTILITY, AND ITS PLANNED EXPENSES TO INSTALL POLLUTION CONTROLS AT SOME OF ITS AGING COAL PLANTS. THROUGH THE CASE, WE OBTAINED A LANDMARK SETTLEMENT AGREEMENT WITH PACIFICORP AND THE OTHER PARTIES REQUIRING THE UTILITY TO ANALYZE ALTERNATIVES FOR COAL PLANT RETIREMENT AND REPLACEMENT BEFORE INVESTING MILLIONS OF MORE DOLLARS IN OLD COAL PLANTS. THROUGHOUT THE YEAR, WE ALSO CONTINUED TO BE A LEADING STATE-WIDE ORGANIZATION PUSHING FOR STRONG POLLUTION CONTROL REQUIREMENTS THROUGH THE REGIONAL HAZE PROGRAM. WYOMING'S REGIONAL HAZE PLAN IS EXPECTED TO BE FINALIZED IN 2012 AND WILL PRESENT THE BEST OPPORTUNITY IN DECADES TO ADDRESS POLLUTION AT COAL PLANTS IN THE STATE. WE ALSO CONTINUED TO SUPPORT OTHER INITIATIVES TO SAFEGUARD THE PUBLIC FROM COAL PLANT POLLUTION, INCLUDING THE AIR TOXICS STANDARDS AND COAL COMBUSTION WASTE DISPOSAL RULES. IN 2011WE MADE PROGRESS IN GETTING THE WYOMING DEQ TO ACKNOWLEDGE AND CHANGE THEIR CBM DISCHARGE POLICY WHICH WAS NOT BASED ON SOUND SCIENCE THAT WOULD PROTECT AGRICULTURAL USES. WE FORCED DEQ TO IMPLEMENT A NEW CBM DISCHARGE POLICY THAT ELIMINATES THE INDUSTRY FAVORED TIER 2 POLICY AND LIMITS WATER DISCHARGE QUANTITY. WE WERE ABLE TO GET DEQ TO ACKNOWLEDGE EXISTING SOIL AND VEGETATION IMPACTS FROM PAST CBM DISCHARGES AND WE CONTINUED PRESSING FOR REAL PROTECTION OF THE AGRICULTURAL USES REGARDING SOIL AND VEGETATION IN THE PERMIT, NOT JUST MONITORING OF DAMAGES IN THE PERMIT. WE KEPT EPA ENGAGED TO OBJECT TO DEQ PERMITS AND TO PRESSURE DEQ TO PROTECT AGRICULTURAL USES. THE EPA FINALLY ANNOUNCED CBM WILL HAVE NATIONWIDE RULEMAKING FOR DISCHARGE STANDARDS. POWDER RIVER PUBLISHED A "STATE OF THE SPLIT ESTATE" REPORT WHICH HIGHLIGHTED THE NEED FOR MORE LANDOWNER PROTECTIONS. IN CONJUNCTION WITH THIS WE CONTINUED TO PUSH FOR REFORMS AND FOR INCREASING "BOND ON" AMOUNTS, WE HIGHLIGHTED INADEQUATE OIL AND GAS BONDING AT THE STATE AND FEDERAL LEVEL WHICH RESULTED IN THE STATE OIL AND GAS COMMISSION INCREASING SOME BONDS AND CONDUCTED PLUGGING AND RECLAMATION OF BANKRUPT CBM WELLS. WE CONTINUED TO LEAD A COALITION OF GROUPS WHO WORKED TO GET STRONGER PROTECTIONS FOR CBM DEVELOPMENT IN THE AREA JUST NORTH OF THE FORTIFICATION WILDERNESS STUDY AREA. WE MOVED THE BLM INTO USING PHASED DEVELOPMENT BASED ON POORLY DEFINED PERFORMANCE STANDARDS FOR ELK AND RECLAMATION AND TO STOP PERMITTING IF REVISED STANDARDS ARE NOT MET. WE WERE ABLE TO KEEP LEASE STIPULATIONS IN THE PERMITS FOR STEEP SLOPES, FRAGILE WATERSHEDS AND ELK HABITAT. OUR MONITORING OF THE PROPOSAL FOR MICROBIAL CONVERSION OF COAL TO GAS RESULTED IN: 1) A LEGISLATIVE REQUIREMENT FOR MONITORING OF DOMESTIC AND LIVESTOCK WATER WELLS WITHIN BIOCONVERSION PROJECT AREA AND MILE OUT, 2) PROTECTED DRINKING WATER AQUIFERS BY PREVENTING CLASS 2 PERMITS ISSUED UNDER THE WYOMING OIL AND GAS CONSERVATION COMMISSION THAT EXEMPT DRINKING WATER PROTECTION, 3) ENSURED DEQ PERMITTING AND REQUIRED MONITORING ACTUALLY PROTECTS DOMESTIC AND LIVESTOCK WATER WELLS, AND 4) KEPT BLM ENGAGED TO ENSURE THEY DO REQUIRED NEPA ANALYSIS OF THIS EXPERIMENTAL PROCESS AND TO ENSURE THE PUBLIC RECEIVES COMPENSATION FOR IMPACTS TO THE COAL RESOURCES IN PROMOTION OF LOCAL FOOD PRODUCTION POWDER RIVER WAS A MAJOR SPONSOR AND CONTRIBUTOR TO THE LOCAL FOODS EXPO AT SHERIDAN COLLEGE. COOPERATIVE EFFORTS WITH LOCAL BUSINESSES AND THE UNIVERSITY OF WYOMING ORGANIZED WHAT WILL BE THE FIRST OF MANY WORKSHOPS AND FORUMS BRINGING TOGETHER ACADEMICS, RANCHERS AND LOCAL FOOD PRODUCERS AND CONSUMERS. POWDER RIVER WAS INITIALLY STARTED IN 1973 BY RURAL LANDOWNERS OF NORTH EAST WYOMING ATTEMPTING TO PROTECT THEIR LAND, WATER AND AIR FROM THE RAVAGES OF COAL STRIP MINING, POWDER RIVER CURRENTLY HAS MEMBERS THROUGHOUT WYOMING AND SEVERAL OTHER STATES AND IS AFFILIATED WITH FOUR GRASSROOTS CITIZEN GROUPS IN WYOMING. POWDER RIVER PUBLISHES THE POWDER RIVER BREAKS ON A BIMONTHLY BASIS FROM JANUARY/ FEBRUARY TO NOVEMBER/DECEMBER OF EACH YEAR. THIS 8 TO 16 PAGE NEWSLETTER CONTAINS INFORMATION ON THE DIFFERENT PROJECTS UNDERTAKEN BY POWDER RIVER IN THE PAST MONTHS. IT IS PROVIDED TO MEMBERS AND IS AVAILABLE TO THE PUBLIC AT DESIGNATED DROP SITES. POWDER RIVER MAINTAINS A WEBSITE AT WWW.POWDERRIVERBASIN.ORG THAT INFORMS AND EDUCATES THE PUBLIC ON CONSERVATION ISSUES THAT POWDER RIVER BASIN RESOURCE COUNCIL IS ADDRESSING. POWDER RIVER BASIN RESOURCE COUNCIL MAINTAINS TWO OFFICE LOCATIONS IN WYOMING. THE MAIN OFFICE IS LOCATED IN SHERIDAN AND THE OTHER IN CLARK. POWDER RIVER'S WORK IS OVERSEEN BY THE POWDER RIVER BASIN RESOURCE COUNCIL BOARD OF DIRECTORS. BOARD MEMBERS ARE ELECTED FROM AND BY THE POWDER RIVER MEMBERSHIP FOR A TWO YEAR TERM. AS A GRASSROOTS ORGANIZATION, MEMBERS DECIDE THE DIRECTION AND FOCUS OF POWDER RIVER'S WORK. MEMBERS BRING RESOLUTIONS FOR A VOTE OF MEMBERSHIP APPROVAL AT THE ANNUAL MEETING THAT IS HELD IN NOVEMBER OF EACH YEAR AND IS OPEN TO THE PUBLIC. PANELS DISCUSSING THE VARIOUS ISSUES ALONG WITH LUNCHEON AND DINNER SPEAKERS PROVIDE INSIGHTS AND INFORMATION AND ARE OPEN TO QUESTIONS FROM THE AUDIENCE THAT NORMALLY EXCEEDS 200 PEOPLE. POWDER RIVER MEMBERS WRITE LETTERS TO THE EDITORS AND EDITORIALS TO LOCAL AND STATE WIDE NEWSPAPERS ADDRESSING THE ISSUES ON WHICH OUR ORGANIZATION IS WORKING ON. EVERY YEAR POWDER RIVER SPONSORS SCHOLARSHIPS AT THE WYOMING HIGH SCHOOL STATE SCIENCE FAIR FOR SCIENCE PROJECTS THAT PROMOTE CONSERVATION AND EDUCATION ON THE PRAIRIE ECOSYSTEMS OF WYOMING. THIS FAIR IS VISITED BY THOUSANDS OF STUDENTS AND ADULTS EACH YEAR. POWDER RIVER BASIN RESOURCE COUNCIL IS THE ONLY GROUP IN WYOMING THAT ACTIVELY ADDRESSES BOTH AGRICULTURAL AND CONSERVATION ISSUES. THE GROUP UNITES BOTH INDIVIDUALS WITH STRONG CONSERVATION CONVICTIONS AND AGRICULTURALISTS WITH A DEEP RESPECT FOR THE LAND AROUND A SHARED VISION TO PROTECT AND IMPROVE WYOMING'S QUALITY OF LIFE. ALSO, POWDER RIVER IS THE ONLY GROUP THAT ADDRESSES SPLIT ESTATE AND PRIVATE PROPERTY RIGHTS IN ADDITION TO PUBLIC LAND ISSUES. POWDER RIVER ACTIVITIES AGAIN WERE THE FOUNDATION OF NATIONAL NEWS WHEN IN DECEMBER 2011 THE EPA RELEASED A REPORT ON THE AQUIFER CONTAMINATIONS IN THE PAVILLION AREA OF WYOMING. OUR AFFILIATE, THE PAVILLION AREA CONCERNED CITIZENS (PACC) INSTIGATED THE EPA INVESTIGATION AND HAS BEEN WORKING WITH EPA AND SUPPORTING THE STUDIES BEING CONDUCTED. EPA DIRECTOR LIZA JACKSON ANNOUNCED THAT OIL AND GAS OPERATIONS INCLUDING FRACKING, WERE LIKELY LINKED TO THE CONTAMINATION. THIS WAS THE FIRST CONFIRMED SCIENTIFIC STUDY LINKING FRACKING TO CONTAMINATION AND THE FLURRY OF RESPONSES WAS PREDICTABLE. OUR MEMBERS WHO HAVE BEEN VERY PUBLIC ABOUT THEIR SUPPORT FOR THE EPA STUDY WERE INUNDATED WITH REQUESTS FROM REPORTERS. INDUSTRY RESPONSE WAS ALSO PREDICTABLE; ACCUSING THE EPA OF CONDUCTING AN INFERIOR INVESTIGATION THAT WOULD HAMPER OIL AND GAS DEVELOPMENT AND STOP FRACKING.
