POWDER RIVER SPEAR-HEADED A COALITION OF GROUPS TO ENSURE THAT THESE PLANTS WILL HAVE TO USE THE LATEST AND BEST TECHNOLOGY TO REDUCE EMISSIONS. WE HAVE ALSO CONDUCTED A COMPLIANCE REVIEW OF AIR QUALITY PERMITS FOR SOME OF THE COAL PLANTS IN THE STATE AND ARE ENGAGED IN FOLLOW-UP AND NEXT STEPS REGARDING PROBLEMS THAT WE IDENTIFIED. THE DEQ RULES FOR CARBON SEQUESTRATION WERE ADOPTED BY THE ENVIRONMENTAL QUALITY COUNCIL (EQC) ON SEPT. 9TH. WYOMING'S RULES ARE FIRST-IN-THE- NATION. WE SUBMITTED COMMENTS TO THE DEQ AND ATTENDED MEETINGS OF THE STATE'S WATER QUALITY ADVISORY BOARD AND EQC. OUR COMMENTS WERE EXTREMELY EFFECTIVE IN LEADING TO CHANGES TO BETTER PROTECT WATER SOURCES IN THE STATE. BECAUSE OF WYOMING GETTING OUT IN FRONT ON THESE ISSUES, WE HAVE DEVELOPED CONSIDERABLE EXPERTISE IN THE AREA AND HAVE PROVIDED ADVICE AND SUPPORT TO GROUPS IN OTHER STATES AND NATIONALLY THAT ARE ADDRESSING CARBON SEQUESTRATION LEGISLATION AND POLICY DEVELOPMENTS. CONCERNING URANIUM MINING OUR PRIMARY FOCUS IS ON THE THREAT PRESENTED BY THE PROCESS OF IN-SITU LEACHING OF URANIUM (ISL), WHICH IS RAPIDLY SPREADING THROUGHOUT THE STATE. COMPANIES ARE IN THE PERMITTING PROCESS FOR ISL SITES AND HAVE SUBMITTED APPLICATIONS TO THE NUCLEAR REGULATORY COMMISSION (NRC). OUR AREAS OF FOCUS IN 2010 INCLUDED: HAVING A VOCAL PRESENCE IN THE PRESS REGARDING URANIUM ISSUES WITH LETTERS TO THE EDITORS, QUOTES IN ARTICLES, AND RADIO INTERVIEWS. SOME OF THESE QUOTES WERE INCLUDED IN THE CASPER STAR TRIBUNE ENERGY JOURNAL AND BROADCAST ON WYOMING PUBLIC RADIO. WE HAVE GIVEN PRESENTATIONS ABOUT OUR CONCERNS WITH ISL TO LOCAL GROUPS, AS WELL AS TO THE ENTIRE STAFF OF THE DEVIL'S TOWER NATIONAL MONUMENT. WE WERE ALSO INVOLVED IN A URANIUM ROUNDTABLE PRESENTATION PUT ON BY THE COUNTY, IN WHICH ONE OR OUR MEMBERS WAS INCLUDED ON A PANEL CONSISTING OF REPRESENTATIVES FROM THE NRC, DEQ, AND INDUSTRY. IN AUGUST, POWDER RIVER ORGANIZER, SHANNON ANDERSON, PRESENTED AT THE UNIVERSITY OF WYOMING'S URANIUM FORUM, WHICH WAS ATTENDED BY APPROXIMATELY 300 REPRESENTATIVES FROM THE URANIUM INDUSTRY AND GOVERNMENT AGENCIES. WE RECENTLY COMPLETED OUR FIRST BROCHURE FOCUSING ON OUR CONCERNS ABOUT URANIUM MINING AND ITS NEGATIVE IMPACTS TO OUR WATER, AND HAVE BEGUN TO DISTRIBUTE THEM BY MAIL AS WELL AS PERSONALLY HANDING THESE OUT TO LANDOWNERS WHO COULD BE IMPACTED BY PROPOSED URANIUM MINES. POWDER RIVER HAS BEEN WORKING WITH A COALITION OF ORGANIZATIONS TO ADDRESS THE NRC'S NEPA PROCESS, WHICH DOES NOT ADEQUATELY CONSIDER THE ENVIRONMENTAL IMPACTS OF URANIUM PROJECTS. IN MAY, WE CO-ORGANIZED A URANIUM ADVOCACY TRIP TO WASHINGTON, DC. REPRESENTATIVES FROM COMMUNITY AND TRIBAL ORGANIZATIONS ACROSS THE WESTERN U.S. MET WITH CONGRESSIONAL DELEGATIONS AND AGENCY REPRESENTATIVES AND DISCUSSED REMOVING URANIUM FROM THE 1872 HARDROCK MINING LAW AND IMPROVING REGULATION TO PROTECT WATER AND LAND RESOURCES. WE HAVE DEVELOPED KEY RELATIONSHIPS AND HAVE SHARED INFORMATION WITH PERSONNEL AT THE WYOMING DEQ, CROOK COUNTY NATURAL RESOURCE DISTRICT, CROOK COUNTY LAND USE PLANNING & ZONING COMMISSION, THE NUCLEAR REGULATORY COMMISSION, AND THE EPA. DEQ HAS BEEN MORE VIGILANT IN THEIR OVERSIGHT OF EXISTING ISL SITES, AS WELL AS THOSE THAT ARE IN EXPLORATION AND DEVELOPMENT PHASE, AND WE FEEL THIS IS PARTIALLY DUE TO KEEPING OUR CONCERNS IN THE FOREFRONT WITH THIS AGENCY. WE ALSO HAD A MEETING WITH THE BLM NEWCASTLE OFFICE, TO INTRODUCE OURSELVES AND DISCUSS OUR CONCERNS WITH THE ISL PROCESS ON PUBLIC LANDS. POWDER RIVER WAS INITIALLY STARTED IN 1973 BY RURAL LANDOWNERS OF NORTH EAST WYOMING ATTEMPTING TO PROTECT THEIR LAND, WATER AND AIR FROM THE RAVAGES OF COAL STRIP MINING, POWDER RIVER CURRENTLY HAS MEMBERS THROUGHOUT WYOMING AND SEVERAL OTHER STATES AND IS AFFILIATED WITH FOUR GRASSROOTS CITIZEN GROUPS IN WYOMING. POWDER RIVER PUBLISHES THE POWDER RIVER BREAKS ON A BIMONTHLY BASIS FROM JANUARY/ FEBRUARY TO NOVEMBER/DECEMBER OF EACH YEAR. THIS 8 TO 16 PAGE NEWSLETTER CONTAINS INFORMATION ON THE DIFFERENT PROJECTS UNDERTAKEN BY POWDER RIVER IN THE PAST MONTHS. IT IS PROVIDED TO MEMBERS AND IS AVAILABLE TO THE PUBLIC AT DESIGNATED DROP SITES. POWDER RIVER MAINTAINS A WEBSITE AT WWW.POWDERRIVERBASIN.ORG THAT INFORMS AND EDUCATES THE PUBLIC ON CONSERVATION ISSUES THAT POWDER RIVER BASIN RESOURCE COUNCIL IS ADDRESSING POWDER RIVER BASIN RESOURCE COUNCIL MAINTAINS TWO OFFICE LOCATIONS IN WYOMING. THE MAIN OFFICE IS LOCATED IN SHERIDAN AND THE OTHER IN CLARK. POWDER RIVER'S WORK IS OVERSEEN BY THE POWDER RIVER BASIN RESOURCE COUNCIL BOARD OF DIRECTORS. BOARD MEMBERS ARE ELECTED FROM AND BY THE POWDER RIVER MEMBERSHIP FOR A TWO YEAR TERM. AS A GRASSROOTS ORGANIZATION, MEMBERS DECIDE THE DIRECTION AND FOCUS OF POWDER RIVER'S WORK. MEMBERS BRING RESOLUTIONS FOR A VOTE OF MEMBERSHIP APPROVAL AT THE ANNUAL MEETING THAT IS HELD IN NOVEMBER OF EACH YEAR AND IS OPEN TO THE PUBLIC. PANELS DISCUSSING THE VARIOUS ISSUES ALONG WITH LUNCHEON AND DINNER SPEAKERS PROVIDE INSIGHTS AND INFORMATION AND ARE OPEN TO QUESTIONS FROM THE AUDIENCE THAT NORMALLY EXCEEDS 200 PEOPLE. POWDER RIVER MEMBERS WRITE LETTERS TO THE EDITORS AND EDITORIALS TO LOCAL AND STATE WIDE NEWSPAPERS ADDRESSING THE ISSUES ON WHICH OUR ORGANIZATION IS WORKING ON. EVERY YEAR POWDER RIVER SPONSORS SCHOLARSHIPS AT THE WYOMING HIGH SCHOOL STATE SCIENCE FAIR FOR SCIENCE PROJECTS THAT PROMOTE CONSERVATION AND EDUCATION ON THE PRAIRIE ECOSYSTEMS OF WYOMING. THIS FAIR IS VISITED BY THOUSANDS OF STUDENTS AND ADULTS EACH YEAR. A MAJOR EMPHASIS OF POWDER RIVER CONTINUES TO BE THE RETURN OF FAIRNESS TO LIVESTOCK MARKETS AND REDUCING CONTROL BY MEAT PACKING CARTELS. THE 2008 FARM BILL REQUIRED USDA TO WRITE RULES TO ADDRESS THE PROBLEMS OF MANIPULATIVE MARKETS AND UNFAIR CONTRACTS AS A FIRST STEP TO ADDRESSING THE PROBLEMS OF THE UNFAIR LIVESTOCK MARKETS. THE FAIR LIVESTOCK MARKETING RULE WAS ISSUED BY USDA'S GRAIN INSPECTION PACKERS AND STOCKYARDS ADMINISTRATION (GIPSA) ON JUNE 22, 2010 AND AIMED AT BRINGING FAIRNESS TO LIVESTOCK AND POULTRY MARKETS. THE NEW RULE CLARIFIES WHICH UNFAIR, DISCRIMINATORY OR DECEPTIVE PRACTICES MEATPACKERS AND THEIR PARTNERS WILL BE PROHIBITED FROM USING IN THE PROCUREMENT OF LIVESTOCK UNDER THE PACKERS AND STOCKYARDS ACT. POWDER RIVER ALONG WITH ITS ALLIES POSTED EXTENSIVE COMMENTS IN SUPPORT OF THE PROPOSED RULES. POWDER RIVER MEMBERS AND OUR ALLIES INCLUDING ICOW, R- CALF AND THE WESTERN ORGANIZATION OF RESOURCE COUNCILS (WORC) HELPED TO PACK THE JOINT USDA/DEPARTMENT OF JUSTICE HEARINGS ON AGRICULTURAL COMPETITION IN FORT COLLINS COLORADO LAST AUGUST 27. POWDER RIVER PUBLISHES THE POWDER RIVER BREAKS ON A BIMONTHLY BASIS FROM JANUARY/ FEBRUARY TO NOVEMBER/DECEMBER OF EACH YEAR. THIS 8 TO 16 PAGE NEWSLETTER CONTAINS INFORMATION ON THE DIFFERENT PROJECTS UNDERTAKEN BY POWDER RIVER IN THE PAST MONTHS. IT IS PROVIDED TO MEMBERS AND IS AVAILABLE TO THE PUBLIC AT DESIGNATED DROP SITES. POWDER RIVER MAINTAINS A WEBSITE AT WWW.POWDERRIVERBASIN.ORG THAT INFORMS AND EDUCATES THE PUBLIC ON CONSERVATION ISSUES THAT POWDER RIVER BASIN RESOURCE COUNCIL IS ADDRESSING POWDER RIVER BASIN RESOURCE COUNCIL MAINTAINS TWO OFFICE LOCATIONS IN WYOMING. THE MAIN OFFICE IS LOCATED IN SHERIDAN AND THE OTHER IN CLARK. POWDER RIVER'S WORK IS OVERSEEN BY THE POWDER RIVER BASIN RESOURCE COUNCIL BOARD OF DIRECTORS. BOARD MEMBERS ARE ELECTED FROM AND BY THE POWDER RIVER MEMBERSHIP FOR A TWO YEAR TERM. AS A GRASSROOTS ORGANIZATION, MEMBERS DECIDE THE DIRECTION AND FOCUS OF POWDER RIVER'S WORK. MEMBERS BRING RESOLUTIONS FOR A VOTE OF MEMBERSHIP APPROVAL AT THE ANNUAL MEETING THAT IS HELD IN NOVEMBER OF EACH YEAR AND IS OPEN TO THE PUBLIC. PANELS DISCUSSING THE VARIOUS ISSUES ALONG WITH LUNCHEON AND DINNER SPEAKERS PROVIDE INSIGHTS AND INFORMATION AND ARE OPEN TO QUESTIONS FROM THE AUDIENCE THAT NORMALLY EXCEEDS 200 PEOPLE. POWDER RIVER MEMBERS WRITE LETTERS TO THE EDITORS AND EDITORIALS TO LOCAL AND STATE WIDE NEWSPAPERS ADDRESSING THE ISSUES ON WHICH OUR ORGANIZATION IS WORKING ON. EVERY YEAR POWDER RIVER SPONSORS SCHOLARSHIPS AT THE WYOMING HIGH SCHOOL STATE SCIENCE FAIR FOR SCIENCE PROJECTS THAT PROMOTE CONSERVATION AND EDUCATION ON THE PRAIRIE ECOSYSTEMS OF WYOMING. THIS FAIR IS VISITED BY THOUSANDS OF STUDENTS AND ADULTS EACH YEAR. A MAJOR EMPHASIS OF POWDER RIVER CONTINUES TO BE THE RETURN OF FAIRNESS TO LIVESTOCK MARKETS AND REDUCING CONTROL BY MEAT PACKING CARTELS. THE 2008 FARM BILL REQUIRED USDA TO WRITE RULES TO ADDRESS THE PROBLEMS OF MANIPULATIVE MARKETS AND UNFAIR CONTRACTS AS A FIRST STEP TO ADDRESSING THE PROBLEMS OF THE UNFAIR LIVESTOCK MARKETS. THE FAIR LIVESTOCK MARKETING RULE WAS ISSUED BY USDA'S GRAIN INSPECTION PACKERS AND STOCKYARDS ADMINISTRATION (GIPSA) ON JUNE 22, 2010 AND AIMED AT BRINGING FAIRNESS TO LIVESTOCK AND POULTRY MARKETS. THE NEW RULE CLARIFIES WHICH UNFAIR, DISCRIMINATORY OR DECEPTIVE PRACTICES MEATPACKERS AND THEIR PARTNERS WILL BE PROHIBITED FROM USING IN THE PROCUREMENT OF LIVESTOCK UNDER THE PACKERS AND STOCKYARDS ACT. POWDER RIVER ALONG WITH ITS ALLIES POSTED EXTENSIVE COMMENTS IN SUPPORT OF THE PROPOSED RULES. POWDER RIVER MEMBERS AND OUR ALLIES INCLUDING ICOW, R- CALF AND THE WESTERN ORGANIZATION OF RESOURCE COUNCILS (WORC) HELPED TO PACK THE JOINT USDA/DEPARTMENT OF JUSTICE HEARINGS ON AGRICULTURAL COMPETITION IN FORT COLLINS COLORADO LAST AUGUST 27. OVER 1,400 FOLKS ATTENDED WITH ROUGHLY SOME FAVORING LIVESTOCK MARKET REFORMS AND CURBING POWER OF THE BIG PACKERS. U.S. SECRETARY OF AGRICULTURE TOM VILSACK DECLARED THE COSTLY AND BURDENSOME NATIONAL ANIMAL IDENTIFICATION SYSTEM DEAD IN FEBRUARY 2010 THIS WAS A DIRECT RESULT OF OUR GRASS-ROOTS EFFORTS, AND HARD WORK BY OUR MEMBERS AND ALLIES ACROSS THE NATION. THE US SENATE AGRICULTURE COMMITTEE WITHDREW ALL FUNDING FOR THE NATIONAL IDENTIFICATION SYSTEM IN THE 2010 BUDGET. WE CONTINUE TO BUILD ON OUR WINS IN 2009 WHEN WE SUCCEEDED IN DEMONSTRATING TO THE ENVIRONMENTAL QUALITY COUNCIL THAT DEQ'S PROPOSED WATER DISCHARGE RULE WAS SCIENTIFICALLY INVALID AND CONVINCED EPA TO BEGIN OBJECTING TO FAULTY PROPOSED CBM DISCHARGE PERMITS. POWDER RIVER SPEAR-HEADED A COALITION OF GROUPS TO ENSURE THAT THESE PLANTS WILL HAVE TO USE THE LATEST AND BEST TECHNOLOGY TO REDUCE EMISSIONS. WE HAVE ALSO CONDUCTED A COMPLIANCE REVIEW OF AIR QUALITY PERMITS FOR SOME OF THE COAL PLANTS IN THE STATE AND ARE ENGAGED IN FOLLOW-UP AND NEXT STEPS REGARDING PROBLEMS THAT WE IDENTIFIED. THE DEQ RULES FOR CARBON SEQUESTRATION WERE ADOPTED BY THE ENVIRONMENTAL QUALITY COUNCIL (EQC) ON SEPT. 9TH. WYOMING'S RULES ARE FIRST-IN-THE- NATION. WE SUBMITTED COMMENTS TO THE DEQ AND ATTENDED MEETINGS OF THE STATE'S WATER QUALITY ADVISORY BOARD AND EQC. OUR COMMENTS WERE EXTREMELY EFFECTIVE IN LEADING TO CHANGES TO BETTER PROTECT WATER SOURCES IN THE STATE. BECAUSE OF WYOMING GETTING OUT IN FRONT ON THESE ISSUES, WE HAVE DEVELOPED CONSIDERABLE EXPERTISE IN THE AREA AND HAVE PROVIDED ADVICE AND SUPPORT TO GROUPS IN OTHER STATES AND NATIONALLY THAT ARE ADDRESSING CARBON SEQUESTRATION LEGISLATION AND POLICY DEVELOPMENTS. CONCERNING URANIUM MINING OUR PRIMARY FOCUS IS ON THE THREAT PRESENTED BY THE PROCESS OF IN-SITU LEACHING OF URANIUM (ISL), WHICH IS RAPIDLY SPREADING THROUGHOUT THE STATE. COMPANIES ARE IN THE PERMITTING PROCESS FOR ISL SITES AND HAVE SUBMITTED APPLICATIONS TO THE NUCLEAR REGULATORY COMMISSION (NRC). OUR AREAS OF FOCUS IN 2010 INCLUDED: HAVING A VOCAL PRESENCE IN THE PRESS REGARDING URANIUM ISSUES WITH LETTERS TO THE EDITORS, QUOTES IN ARTICLES, AND RADIO INTERVIEWS. SOME OF THESE QUOTES WERE INCLUDED IN THE CASPER STAR TRIBUNE ENERGY JOURNAL AND BROADCAST ON WYOMING PUBLIC RADIO. WE HAVE GIVEN PRESENTATIONS ABOUT OUR CONCERNS WITH ISL TO LOCAL GROUPS, AS WELL AS TO THE ENTIRE STAFF OF THE DEVIL'S TOWER NATIONAL MONUMENT. WE WERE ALSO INVOLVED IN A URANIUM ROUNDTABLE PRESENTATION PUT ON BY THE COUNTY, IN WHICH ONE OR OUR MEMBERS WAS INCLUDED ON A PANEL CONSISTING OF REPRESENTATIVES FROM THE NRC, DEQ, AND INDUSTRY. IN AUGUST, POWDER RIVER ORGANIZER, SHANNON ANDERSON, PRESENTED AT THE UNIVERSITY OF WYOMING'S URANIUM FORUM, WHICH WAS ATTENDED BY APPROXIMATELY 300 REPRESENTATIVES FROM THE URANIUM INDUSTRY AND GOVERNMENT AGENCIES. WE RECENTLY COMPLETED OUR FIRST BROCHURE FOCUSING ON OUR CONCERNS ABOUT URANIUM MINING AND ITS NEGATIVE IMPACTS TO OUR WATER, AND HAVE BEGUN TO DISTRIBUTE THEM BY MAIL AS WELL AS PERSONALLY HANDING THESE OUT TO LANDOWNERS WHO COULD BE IMPACTED BY PROPOSED URANIUM MINES. POWDER RIVER HAS BEEN WORKING WITH A COALITION OF ORGANIZATIONS TO ADDRESS THE NRC'S NEPA PROCESS, WHICH DOES NOT ADEQUATELY CONSIDER THE ENVIRONMENTAL IMPACTS OF URANIUM PROJECTS. IN MAY, WE CO-ORGANIZED A URANIUM ADVOCACY TRIP TO WASHINGTON, DC. REPRESENTATIVES FROM COMMUNITY AND TRIBAL ORGANIZATIONS ACROSS THE WESTERN U.S. MET WITH CONGRESSIONAL DELEGATIONS AND AGENCY REPRESENTATIVES AND DISCUSSED REMOVING URANIUM FROM THE 1872 HARDROCK MINING LAW AND IMPROVING REGULATION TO PROTECT WATER AND LAND RESOURCES. WE HAVE DEVELOPED KEY RELATIONSHIPS AND HAVE SHARED INFORMATION WITH PERSONNEL AT THE WYOMING DEQ, CROOK COUNTY NATURAL RESOURCE DISTRICT, CROOK COUNTY LAND USE PLANNING & ZONING COMMISSION, THE NUCLEAR REGULATORY COMMISSION, AND THE EPA. DEQ HAS BEEN MORE VIGILANT IN THEIR OVERSIGHT OF EXISTING ISL SITES, AS WELL AS THOSE THAT ARE IN EXPLORATION AND DEVELOPMENT PHASE, AND WE FEEL THIS IS PARTIALLY DUE TO KEEPING OUR CONCERNS IN THE FOREFRONT WITH THIS AGENCY. WE ALSO HAD A MEETING WITH THE BLM NEWCASTLE OFFICE, TO INTRODUCE OURSELVES AND DISCUSS OUR CONCERNS WITH THE ISL PROCESS ON PUBLIC LANDS. IN 2009, OUR MEMBERS WERE INSTRUMENTAL IN MOVING AN APPLICATION FOR PERMIT TO DRILL FOR GAS ON THE SHOSHONE NATIONAL FOREST INTO AN ENVIRONMENTAL ASSESSMENT, RATHER THAN THE PROPOSED CATEGORICAL EXCLUSION ORIGINALLY CONSIDERED THROUGH NEPA REQUIREMENTS.
