“The halquist memorial inpatient center was licensed in 1981 as one of the first hospice inpatient centers in the united states and the first in the state of virginia. As such, the state of virginia had no category for licensure that would fit the facility and therefore licensed the unit as a general hospital. As a hospice inpatient center, the facility has no emergency room, outpatient center, labs, or other diagnostic services as would a general hospital. It serves only capital hospice patients requiring acute symptom management or patients in their final days of a terminal illness who can no longer be served at home. The unit has 15 beds and represents on average only 13 of the more than 1300 patients that are treated by capital hospice on a daily basis. As a result, the community health needs assessment is not applicable to hospice inpatient beds. In states other than virginia, units like halquist are licensed as hospice centers and are not subject to either the community health needs assessment or form 990, schedule h. It is for this reason that capital caring is filing form 990 as a public charity described under section 170(b)(1)(a)(vi) of the internal revenue code. Similarly, medicare has recognized that our unit is not actually a hospital and has not required us to comply with many of the reporting requirements applicable to hospitals.”

“The hospice, which includes the operations of cpcc, are exempt from income taxes on income from related activities under section 501(c)(3) of the u.s. Internal revenue code and corresponding state tax law. Accordingly, no provision has been made for federal or state income taxes. U.s. Gaap requires that a tax position is recognized as a benefit only if its is "more likely than not" that the tax position would be sustained in a tax examination, with a tax examination being presumed to occur. The amount recognized is the largest amount of tax benefit that is greater than 50% likely of being realized on examination. The form 990 has not been subject to examination by the itnernal revenue service or the state of virginia for the last three years. The company does not expect the total amount of unrecognized tax benefits to significantly change in the next 12 months. The company recognizes interest and/or penalties related to income tax matters in income tax expense. The company did not have any amounts accrued for interest and penalties at december 31, 2019 and 2018.”
