THEREFORE, NO PROVISION FOR INCOME TAXES HAS BEEN REFLECTED IN THESE FINANCIAL STATEMENTS. IN ADDITION, THE COUNCIL HAS BEEN DETERMINED BY THE INTERNAL REVENUE SERVICE NOT TO BE A "PRIVATE FOUNDATION" WITHIN THE MEANING OF SECTION 509(A) OF THE INTERNAL REVENUE CODE. THE COUNCIL FILES INFORMATION RETURNS IN THE U.S. FEDERAL JURISDICTIONS AND THE STATE OF MINNESOTA. WITH FEW EXCEPTIONS, THE COUNCIL IS NO LONGER SUBJECT TO U.S. FEDERAL, STATE AND LOCAL EXAMINATIONS BY TAX AUTHORITIES FOR YEARS BEFORE 2009. THE COUNCIL BELIEVES ITS INFORMATIONAL FILING POSITIONS AND DEDUCTIONS WOULD BE SUSTAINED ON AUDIT AND DOES NOT ANTICIPATE ANY ADJUSTMENTS THAT WOULD RESULT IN A MATERIAL ADVERSE EFFECT ON THE COUNCIL'S FINANCIAL CONDITION, RESULTS OF OPERATIONS, OR CASH FLOW FROM UNRECOGNIZED TAX BENEFITS. THE COUNCIL RECOGNIZES INTEREST ACCRUED RELATED TO UNRECOGNIZED TAX BENEFITS, IF ANY, IN INTEREST EXPENSE AND PENALTIES IN OPERATING EXPENSES.
