Mission

The foundation uses contributions to fund research for pediatric cancer drugs, including underwriting a lab at memorial sloan-kettering cancer center, and also financially supports low income families and military families who have children with cancer. It also pursues legislative and regulatory changes that seek to benefit children with cancer and at the same time to raise awareness of issues involving pediatric cancer. In addition, the foundation also donates limited funds to other 501(c)(3)charities not directly related to pediatric cancer causes which assist the foundation in its mission stated above.

Schedule I

1. In 2016, max cure foundation (mcf) donated a total of $261,302 to other charities and to families in its roar beyond barriers program. In that regard, $56,135 was directly donated by mcf to the max cure fund (mc fund) at memorial sloan kettering cancer center (mskcc) to be used towards funding an immune cell therapy lab (with an additional $7,493 being donated directly to the mc fund by a donor who ran the 2015 new york city marathon in honor of mcf as of december 31, 2016, bringing the total contributed by mcf to the mc fund to $925,000). An additional $50,000 was donated to the joy fund at mskcc which provides for recreation, arts and crafts and other amenities for pediatric patients in treatment at the hospital. The following donations were made to other non-profits: friends of st. Catherines park - park located adjacent to mskcc in manhattan where children being treated at mskcc congregate and play ($40,000); connor cures foundation, a pediatric cancer foundation ($7,000); casa grande union high school - joint fundraiser with mcf ($5,407); crohn's & colitis foundation of america - foundation supported by a substantial donor of mcf ($1,500); westfield recreation center - mcf was a sponsor of a 5k race ($500); coalition against childhood cancer (cac2) - mcf is a founding member of this collaborative organization of foundations and others supporting pediatric cancer issues ($300); katy's courage corp. - a foundation formed in memory of katy stewart, the first child with cancer whose family received assistance from mcf ($50). The total thus paid to other non-profits is $160,892. In addition, the sum of $100,411 was paid to, or on behalf of, 60 families battling cancer in their children who in 2016 were included in the mcf roar beyond barriers program. Hence, as noted, the total donations made by mcf to non-profits and families in 2016 is $261,303. 2. In 2016, the foundation made payments to 60 low income and military families battling pediatric cancer as part of its roar beyond barriers program. These families, whose children are in active cancer treatment, reside in 14 states at 19 hospitals throughout the country (the foundation is registered as a 501(c)(3) in all states requiring such registrations to solicit funds in those states plus the district of columbia). Since the program was launched in november, 2011, over 120 families have been financially assisted. Such assistance takes the form primarily of issuing to the families monthly gift cards from walmart and sam's club to allow the families to buy necessities such as food and clothing. Medical expenses are otherwise covered for these families through medicaid or through state or federal unreimbursed medical cost programs. In addition to the monthly gift cards, on occasion the foundation assists the families by providing them with monies to pay certain bills in arrears (where there are threatened shutdowns, for example, of utility services) and also, by providing nutritional supplements needed to boost the child's immune system in such circumstances where the family would otherwise not be able to give the child such supplements given financial constraints being confronted by the family. The roar beyond barriers program continues to expand in 2017 so that by year end, the foundation will have included well in excess of 120 families in the program since its launch, as noted, in november, 2011. It was a successful year for the foundation in seeking to advance its mission of family assistance. The foundation has donated over $500,000 to families since its formation in 2008 in its effort to lessen the stresses families experience when battling cancer in their children. 3. In 2016, in addition to providing families with financial assistance, the foundation undertook in early december to bring kristian, a terminally ill 7 year old with cancer, his wish, namely, that his stepfather, sgt. 7. In 2014, mcf officially added advocacy to its mission to advance the cause of childhood cancers. Mcf has been in the forefront of the childhood cancer advocacy community since 2011 by relentlessly pursing legislation and regulatory changes that seek to benefit children diagnosed with cancer and at the same time, to raise awareness generally of issues applicable to childhood cancer. Of particular significance in 2014 was the case of josh hardy. Josh had experienced four bouts of kidney cancer from the age of 9 months and in january, 2014, at the age of 7, had a bone marrow transplant which resulted in his being diagnosed in mid-february with a life threatening adenovirus given his immune system was totally compromised. The available medications which had been approved by the fda and which were used in josh's treatment were not working and as of march 7, 2014, he was given two weeks to live unless, according to his treating doctors, he was given an experimental drug known as brincidofovir which was manufactured by chimerix, a bio tech firm in north carolina. Chimerix continued to decline the request by josh's treating doctors to give josh the drug consistent with its having declined since 2012 over 300 prior requests by terminally and seriously ill patients. Mcf agreed on march 7, 2014, to attempt to get the drug for josh which hopefully would save his life. Ultimately, due primarily to the efforts of mcf, josh on march 12, 2014 received the drug, which is credited with saving his life. When the former ceo of chimerix is asked what distinguished josh hardy from the over 300 requests by seriously and terminally ill patients that the company declined, he advised that he answers in two words, referring to the foundation's vice-chairman, "richard plotkin." josh's health continued to improve 2.5 years following his being given the drug although he had recently encountered what appeared to be serious health issues. In an article appearing in the boston globe magazine on july 19, 2015 by sylvia pagan westphal titled, "sick kids, desperate parents, and the battle for experimental drugs," the author, with reference to the events which led to the saving of josh's life, said: "the family was introduced to richard plotkin, [characterized in the article as "an aggressive patient advocate who masterfully choreographed a pr siege against the company"], a former litigation lawyer who heads the max cure foundation, which he founded after his grandson was diagnosed with lymphoma. With the same relentless energy once deployed in the courtroom, plotkin plunged headlong into the hardy cause, directing its pr campaign." see also an article in the june, 2016, issue of harper's magazine entitled, "hashtag prescription, the hidden cost of crowd-sourcing a cure" which discusses richard's role in this seminol case involving josh hardy. The experimental drug, as noted, cured the adenovirus afflicting josh. Sadly, though, on september 22, 2016, josh, at age 10, succumbed to the cancer that had afflicted him for his entire life. In 2014, mcf's vice president, richard plotkin, was appointed to an advocacy committee dealing with the white house on issues relating to pediatric cancers. He has also been interviewed on national public radio (npr) and on cbs radio regarding his role in the josh hardy matter. In addition, richard has been invited to participate in panel discussions at various industry conferences and has been a featured speaker at other times to various audiences, all of which dealt with his efforts to save the life of josh hardy and how his efforts were successful when those of over 300 prior patients' requests for brincidofovir were denied. This included a presentation in february 2015 at harvard medical school where he spoke on the issue of the legal and ethical issues arising out of the josh hardy matter.
