The mission of the york county bar foundation, the charitable arm of the york county bar association, is to: *increase access to justice for all people, particularly those struggling with poverty and abuse; *improve the administration of justice; *promote public understanding of and respect for the law; *encourage careers and diversity in the legal system; *improve the quality of life for york countians through support for law-related community initiatives.

The board of directors are given a draft of the form 990 to review and approve before it is filed.

Form 990, Part VI, Section B, Line 12C

Any board member, officer, member of a committee with board delegated powers or employee who has a direct or indirect financial interest or duality of interest is an interested person. An interested person must disclose the existence of his or her financial interest or affiliation and all material facts to the directors and members of committees with board delegated powers considering the proposed transaction or arrangement. The disclosure should be made either when the interest becomes a matter of board or committee action or as part of a periodic procedure to be established by the board. After disclosure of the financial interest and all material facts, and after any discussion with the interested person, the remaining board or committee members shall decide by motion and affirmative vote of the board or committee, if a conflict of interest exists. An interested person may make a presentation at the board or committee meeting, but after such presentation, he or she may be required to leave the meeting by motion and affirmative vote of the board or committee during the discussion of, and the vote on, the transaction or arrangement that results in the conflict of interest. Each board member, officer, member of a committee with board delegated powers and employee shall annually sign a statement which affirms that such person: a. Has received a copy of the conflict of interest policy, b. Has read and understands the policy, c. Has agreed to comply with the policy, and d. Understands that the ycbf is a charitable organization and that in order to maintain its federal tax exemption it must engage primarily in activities which accomplish one or more of its tax-exempt purposes.

The foundation's policy is to prepare its financial statements on a modified cash basis.

FORM 990, PART XII, LINE 2C;

The audit committee shall establish criteria for the selection and evaluation of any outside auditing firm conducting and audit, and recommend appointment of and fees of such auditors. The finance and budget committee shall advise the board on all business and financial matters including periodic review of the financial position of the corporation and compilation of the annual financial statements of the corporation.

Financial Statement Notes

PART V, LINE 4:

The foundation's endowments consist of several funds established for a variety of purposes. Its endowments include a donor-restricted endowment fund as well as several funds designated by the board of directors to function as endowments. The policy of the foundation states it is the intention of the board of directors to set the payout rate at a level to provide for a disciplined stream of income. The spending policy for each individual endowment fund is based on the rolling twelve-quarter average of the market values of the fund. For the year ending december 31, 2016, the board of directors approved a payout rate of up to 4% on certain designated endowment funds. The foundation is a beneficiary of an endowment fund of york county community foundation. The community foundation maintains variance power over distributions from the fund. As beneficiary, the foundation is entitled to annual distributions from the fund, based upon the community foundation's spending policy.

PART X, LINE 2:

Accounting principles require management to evaluate tax positions taken by the foundation, including whether the entity is exempt from income taxes. Management evaluated the tax positions taken and concluded that the foundation had taken no uncertain tax positions that require recognition or disclosure in the financial statements. With few exceptions, the foundation is no longer subject to income tax examinations by the u.s. Federal, state, or local authorities for years before december 31, 2013.

THE RICHARD NOLL SCHOLARSHIP COMMITTEE AWARDED TWO SCHOLARSHIPS TO "DESERVING, NEEDY LAW STUDENT(S) FROM THE GREATER YORK AREA." THE RECIPIENTS WERE DWIGHT QUICHUA AND JENNIFER BRENEMAN. THE YCBA MILITARY & VETERANS COMMITTEE RECOGNIZED WILLIAM PENN HIGH SCHOOL JROTC MEMBER JOSE L. VELAZQUEZ FOR HIS DEDICATED INVOLVEMENT IN THE YOUTH COURT ALLIANCE. UNDER THE LEADERSHIP OF EXECUTIVE DIRECTOR DR. MATT HOWIE, THE YROC IS FOCUSED ON EDUCATING CITIZENS OF THE PREVALENCE OF THE HEROIN PROBLEM, THE SIGNS AND SYMPTOMS OF ADDICTION, AND THE RESOURCES AVAILABLE AS WELL AS TO REDUCING DRUG RELATED DEATHS AND CRIME IN OUR COMMUNITIES THROUGH PUBLIC EDUCATION, ADVOCACY, LAW ENFORCEMENT AND LEGISLATION. FUNDING WAS PROVIDED FOR YORK COUNTY TREATMENT COURT INCENTIVES AND ALSO RESERVED FOR FUTURE GRANTS FOR THE ORPHANS' COURT GURADIAN MONITOR PROGRAM (CARRIED OVER FROM 2015).FUNDING WAS GRANTED TO YWCA YORK FOR THE ESTABLISHMENT OF THE NEW YWCA YORK CENTER FOR JUSTICE AND ADVOCACY TO MEET THE LEGAL NEEDS OF VICTIMS OF DOMESTIC AND SEXUAL VIOLENCE. THE CITY OF YORK WAS AWARDED FUNDS TO LAUNCH THE GUN VIOLENCE INTERVENTION INITIATIVE (OPERATION CEASEFIRE) FOCUSING ON REDUCING GUN VIOLENCE BY INDIVIDUAL OFFENDERS. THE PROGRAM BRINGS PAROLEES WITH HISTORIES OF VIOLENCE AND/OR GUN OFFENDING INTO A CALL-IN; INFORMS THEM OF THE LEGAL RISKS OF, ESPECIALLY, THE FEDERAL FELON-IN-POSSESSION GUN LAWS TO WHICH THEY ARE NOW SUBJECT; CONVEYS CLEAR ANTIVIOLENCE MESSAGES FROM COMMUNITY MEMBERS AND EX-OFFENDERS, AND SPELLS OUT SOCIAL SERVICE OPPORTUNITIES. MID PENN LEGAL SERVICES RECEIVED THE LION'S SHARE OF THE AVAILABLE ASSISTANCE, WITH GRANTS AND ALTERNATIVE PRO BONO SERVICE FUNDING TO SUPPORT PRO BONO SERVICES AND TO PRESERVE THEIR CRITICALLY NEEDED FAMILY-LAW ATTORNEY POSITION IN THE YORK OFFICE.PENNSYLVANIA IMMIGRATION RESOURCE CENTER RECEIVED A GRANT TO RETAIN STAFF AND SUPPORT ITS OPERATIONS IN PROVIDING DIRECT REPRESENTATION, INDIVIDUAL AND GROUP LEGAL ORIENTATIONS, SELF-HELP WORKSHOPS, AND OTHER SERVICES TO THE GROWING IMMIGRANT POPULATIONS. THIS INCLUDES BUT IS NOT LIMITED TO THE ESTIMATED 500 DETAINEES PRIMARILY HOUSED AT THE YORK COUNTY PRISON AND THOSE AT THE FAMILY DETENTION SHELTER IN BERKS COUNTY WHICH IS THE ONLY FAMILY DETENTION CENTER IN THE NATION. IN 2010, THE YCBA'S YOUNG LAWYERS SECTION LAUNCHED THE WILLS FOR HEROES PROGRAM IN PARTNERSHIP WITH THE WILLS FOR HEROES FOUNDATION, THE PA BAR ASSOCIATION AND LEAVE A LEGACY YORK COUNTY. THE EIGHTH EVENT WAS HELD ON SEPTEMBER 10, 2016. THANKS TO THE EFFORTS OF ATTORNEY MAC BRILLHART, 31 VOLUNTEER ATTORNEYS AND PARALEGALS, PROFESSIONAL ADVISORS AND OTHERS PROVIDED 56 VETERANS AND EMERGENCY RESPONDERS WITH WILLS, LIVING WILLS, AND HEALTH CARE AND FINANCIAL POWERS OF ATTORNEY. NOTARIZED LEGAL DOCUMENTS WERE PROVIDED FREE OF CHARGE. TO DATE, 392 VETERANS, POLICE OFFICERS, FIRE FIGHTERS, OTHER EMERGENCY SERVICES PERSONNEL AND THEIR SIGNIFICANT OTHERS HAVE RECEIVED THIS IMPORTANT LEGAL SERVICE. IN THE SPRING OF 2016, THE YCBA PARTICIPATED IN AN EXPUNGEMENT CLINIC, THE FIRST IN YORK COUNTY, AT THE REQUEST OF MAYOR C. KIM BRACEY AND REPRESENTATIVE KEVIN SCHREIBER, TO SCREEN YORK COUNTY CITIZENS WHO MIGHT BE ELIGIBLE TO HAVE THEIR CRIMINAL RECORDS EXPUNGED, AND IDENTIFY THOSE THAT MIGHT BE ELIGIBLE FOR PRO BONO ASSISTANCE. PARTNERS INCLUDED THE PHILADELPHIA LAWYERS FOR SOCIAL EQUITY, MIDPENN LEGAL SERVICES, PA CAREERLINK YORK COUNTY AND 16 ATTORNEY AND LEGAL PROFESSIONAL VOLUNTEERS. OUTCOMES: 89 ATTENDEES AND 65 SERVED. THERE WERE 18 PRO BONO, 3 MODEST MEANS, 10 LAWYER REFERRALS. 32 DID NOT QUALIFY AND 2 WERE OUT OF COUNTY. MOST SIGNIFICANTLY, FOLLOWING A MEETING WITH COURT ADMINISTRATION, PLANS ARE UNDERWAY TO ENSURE THE FILING FEES WILL BE WAIVED FOR THOSE THAT QUALIFY FOR PRO BONO. YCBA ATTORNEY CHARLES RAUSCH AND SPOUSE, TONI, WERE ALSO RECOGNIZED FOR THEIR INDIVIDUAL CONTRIBUTIONS TO ACCESS TO JUSTICE. THE PENNSYLVANIA LEGAL AID NETWORK RECENTLY HONORED JUDGE JOHN C. UHLER AND ROBERT J. WOODS OF THE UNITED WAY OF YORK COUNTY WITH THE 2014 EXCELLENCE AWARD FOR THEIR JOINT LEADERSHIP OF THE YCBA/YCBF COMMUNITY-WIDE LEGAL SERVICES TASK FORCE. IN 2012, THE YORK COUNTY BAR FOUNDATION RECEIVED THE PRESTIGIOUS LOUIS J. GOFFMAN AWARD FROM THE PA BAR FOUNDATION FOR IT LEADERSHIP AND SERVICE AS A MAJOR PARTNER IN THE YORK COUNTY TRUANCY PREVENTION INITIATIVE. THE YORK COUNTY BAR IS THE ONLY BAR IN THE STATE TO RECEIVE THE AWARD FOUR TIMES. YCBA RECEIVED THREE GOFFMAN AWARDS FOR ITS LEADERSHIP IN ENSURING THAT THE UNDERREPRESENTED HAVE ACCESS TO LEGAL ADVICE. EDUCATING STUDENTS AND CITIZENS - MOCK TRIALS, LAW DAY ACTIVITIES, LAW MENTORING FOR HIGH SCHOOL STUDENTS, AND EDUCATIONAL VIDEOS FOR PROSPECTIVE JURORS AND VISITORS TO THE JUDICIAL CENTER ARE AMONG THE BAR'S PUBLIC SERVICE ACTIVITIES TO ENCOURAGE UNDERSTANDING OF AND RESPECT FOR THE LAW. THE PUBLIC SERVICE COMMITTEE ALSO CONTINUES TO PRODUCE THE LEGAL LINES CABLE TELEVISION PROGRAM. THESE PROGRAMS AIR ON THE LOCAL CABLE STATION. THEY ARE ALSO AVAILABLE THROUGH THE YORK COUNTY LIBRARY SYSTEM AND CAN BE ACCESSED THROUGH THE YORK COUNTY BAR WEBSITE, YOUTUBE CHANNEL AND FACEBOOK PAGE. "HELPING FAMILIES AND YOUTH SUCCEED - THE YCBA FAMILY LAW SECTION, IN PARTNERSHIP WITH THE YORK COUNTY COURT APPOINTED SPECIAL ADVOCATES (CASA), SPONSORED A SCREENING OF THE MOVING DOCUMENTARY FILMS REMOVED (PARTS 1 AND 2) AT YORK COLLEGE OF PENNSYLVANIA. REMOVED FOLLOWS THE EMOTIONAL JOURNEY OF A NINE-YEAR OLD GIRL WHO IS TAKEN FROM HER ABUSIVE BIRTH HOME AND PLACED IN THE TUMULTUOUS FOSTER CARE SYSTEM. MORE THAN 200 ATTENDED THE SCREENING WHICH WAS FREE TO THE PUBLIC AND WAS FOLLOWED BY A PANEL DISCUSSION ON CHILD ABUSE/NEGLECT AND THE FOSTER CARE SYSTEM.TO FURTHER RAISE AWARENESS AND SUPPORT FOR REALLOCATING DOLLARS USED FOR INCARCERATION INTO TREATMENT PROGRAMS, THE PUBLIC SERVICE COMMITTEE SPONSORED A PRESENTATION BY THE HONORABLE MICHAEL P. BOGGS OF THE GEORGIA COURT OF APPEALS AND CO-CHAIR OF THE GEORGIA COUNCIL CRIMINAL JUSTICE REFORM AT A SPECIAL MEETING OF THE PBA CORRECTIONS COMMITTEE SUBCOMMITTEE ON PRISON OVERCROWDING. THE MEETING WAS HELD AT THE PENNSYLVANIA BAR ASSOCIATION HEADQUARTERS IN HARRISBURG AND HOSTED BY THE HONORABLE JOHN KENNEDY, CHAIR OF THE PRISON OVERCROWDING SUBCOMMITTEE WITH INTRODUCTORY REMARKS BY SENATOR GREENLEAF. THE MEETING WAS VIDEO-CONNECTED TO THE CRIMINAL JUSTICE ADVISORY BOARD CONFERENCE IN STATE COLLEGE THAT WAS ATTENDED BY 250 PEOPLE. REPRESENTATIVES OF THE YCBF INCLUDED CAROLYN STEINHAUSER, TIM BARKER, VICTORIA CONNOR AND JUDGE KENNEDY.THE YCBA WOMEN IN LAW COMMITTEE SPONSORED A COLLECTION OF ROLLER BAGS/SUITCASES/DUFFEL BAGS/BACK PACKS FOR CHILDREN BEING PLACED IN FOSTER CARE AS A PART OF THE "NO MORE TRASH BAGS" CAMPAIGN IN PARTNERSHIP WITH YORK COUNTY CHILDREN AND YOUTH, IN COLLABORATION WITH THE SOUTH-CENTRAL YOUTH ADVISORY BOARD. THE GOAL IS TO MAKE SURE THAT EVERY CHILD THAT IS PLACED IN FOSTER CARE IN YORK COUNTY HAS A SUITCASE FOR THEIR PERSONAL BELONGINGS TO ELIMINATE THE STIGMA AND HUMILIATION THAT CHILDREN SOMETIMES FACE WHEN ENTERING THE FOSTER CARE SYSTEM AND HAVING NOTHING AVAILABLE TO THEM IN WHICH TO TRANSPORT THEIR PERSONAL BELONGINGS. 40 ITEMS WERE DONATED."
