Our vision of a stronger, innovative, globally Competitive and more vibrant region is empowered by our mission to support the Bay Area Council and invest philanthropic resources toward building stronger more vibrant communities; a health economy and a more innovative and globally competitive and sustainable Bay Area. Backed by the Bay Area Council a 501c4 organization with over 60 years of experience and sucessful track record in the policy arena, we provide a strong framework and resource base for addressing the interdependent forcesthat govern the regional economy with an eye on local, state, national and international factors. The Foundation work can be summarized in three key words. Researching; Educating; Implementing

The bay area council foundation (bacf) is a 501(c)(3) charitable organization founded in 2004 to fund, manage and implement initiatives that impact the entire bay area region of california. The mission of bacf is to support the bay area council (bac) and invest philanthropic resources toward building stronger, more vibrant communities, a healthy economy, and a more innovative, globally competitive and sustainable bay area region. We do not make grants and function largely as an operating foundation.

Our tax return is reviewed and prepared by our independent cpa firm. The program elements are prepared by senior management to include the ceo and cfo. The cpa firm also performs the independent financial audit as required by the board of directors. Financial results and program figures are included herein. Financial results are reported to the executive committee of the board for their review prior to filing.

The finance and administrative departments regularly monitor for conflicts of interest. Our conflict of interest policy is included in our employee hr handbook. Directors, officers and employees are required to sign a conflict of interest statement.

PART X, LINE 2:

Bay area council inc. Is exempt from taxation under internal revenue code section 501(c)(4) and bacf is exempt as a 501(c)(3). Bac llc is subject to both federal and state taxation. For the 2019 financial year, bac llc did not generate any income. There was no federal and state tax liabilities due for the years ended december 31, 2019. Generally accepted accounting principles provide accounting and disclosure guidance about positions taken by an organization in its tax returns that might be uncertain. Management has considered its tax positions and believes that all of the positions taken by bac in its federal and state exempt organization tax returns are more likely than not to be sustained upon examination. Bac's returns are subject to examination by federal and state taxing authorities, generally for three and four years, respectively, after they are filed. The china wfoe is subject to chinese enterprise income tax ("eit"), value added tax ("vat") applied to certain districts in china, and business income tax ("bit") prescribed by chinese tax laws and ordinances. During 2019, the china government tax authorities audited the wfoe for compliance and found no exceptions in recording of the tax liability and subsequent payments associated with taxes due.
