Financial Statement Notes

Fin 48 Footnote - Form 990, Sch D, Part X, Line 2

The Foundation follows the accounting guidance in FASB ASC Topic 740, "Income Taxes," which provides guidance on the accounting for uncertainty in income tax positions. The Foundation classifies interest and penalties on such uncertainties as income tax expense. Although the Foundation is exempt from Federal income taxes under Section 501(a) of the Internal Revenue Code (the "Code"), it is possible that the Foundation's tax-exempt status could be challenged by the Internal Revenue Service ("IRS"). Additionally, due to ambiguity of provisions of the Code pertaining to "Unrelated Business Income," the IRS could assess income taxes on income earned by the Foundation, which the Foundation believes is not subject to income taxes. The Foundation believes it has sufficient support to withstand any such challenges and, accordingly, has not recorded a liability for such an event. The tax years that remain subject to examination by the IRS are the years ended April 30, 2012 through April 30, 2015 and by the California Franchise Tax Board are the years ended April 30, 2011 through April 30, 2015. There were no tax examinations in progress as of April 30, 2015.
