FORM 990, PART III, LINE 3:

On august 17, 2017, fh homes housing development funding corporation assumed administration of the program formerly owned by the reporting organization: a 20-unit apartment facility located at 2264-66 amsterdam avenue in manhattan, new york. The contract with the funding source for the reporting organization was transferred to the fh homes housing development funding corporation on such date. Form 990, part vi, section a, line 8b: the organization has no separate committees that act on behalf of the governing body.

FORM 990, PART XI, LINE 9:

F.H. Community living program, inc. ("fhcl") was incorporated in 1984 as a wholly-controlled entity of fountain house, inc. ("fhi"), a related 501(c)(3) organization. Accordingly, the FHCL operates a 20-unit apartment facility located at 2264-66 Amsterdam Avenue in Manhattan, New York (the "Project"). The Project was substantially financed by the US Department of Housing and Urban Development ("HUD"), a corporate government agency, and the Public Benefit Corporation of the State of New York. Fh homes housing development funding corporation (the "corporation") was incorporated in 2015 as a wholly-controlled entity of FHI. The corporation is recognized by the IRS as tax-exempt under section 501(c)(4) of the Internal Revenue Code pursuant to a ruling issued by the IRS on January 17, 2017. The corporation commenced operations on august 17, 2017 to consolidate the program activities and refinance the debt of both fountain house housing, inc. ("fhh") and FHCL, two entities also wholly controlled by fhi. As part of the refinancing transaction, the corporation received a new mortgage on august 17, 2017 for $5,018,900 and approval from hud to use the mortgage proceeds to pay off all existing mortgages for fhh and fhcl as of august 16, 2017, existing liabilities due to hud and outstanding liabilities for fhh and fhcl that were due to fhi. In addition, FHCL transferred all of its fixed assets to the corporation as part of a Bargain and Sale Deed (the "Deed") that was signed on August 17, 2017 by FHCL, FHH and the Corporation. This Deed granted and released all land located at 2264-66 Amsterdam Avenue and 441-445 West 47th Street in Manhattan, along with the buildings and improvements and equipment, to the Corporation. The aforementioned events amounted to $487,671 for FHCL. Accordingly, on august 17, 2017, the corporation assumed administration of the two programs formerly owned by fhh and fhcl which are: (1) a 20-unit apartment facility located at 2264-66 amsterdam avenue in manhattan, new york; and (2) a 19-unit apartment facility located at 441-445 west 47th street in manhattan, new york. The contracts with the funding source for fhh and fhcl were transferred to the corporation on august 17, 2017.

PART X, LINE 2:

Under accounting standards codification ("asc") 740, "income taxes," an organization must recognize the financial statement effects of a tax position taken for tax return purposes when it is more likely than not that the position will not be sustained upon examination. F.h. Community living program, inc. (the "reporting organization") does not believe it has taken any material uncertain tax positions and, accordingly, it has not recorded any liability for unrecognized tax benefits. The reporting organization has filed for and received income tax exemptions in the jurisdictions where it is required to do so. For the year ended december 31, 2017, there were no interest or penalties recorded or included in the statements of activities. The reporting organization is subject to routine audit by a taxing authority. As of december 31, 2017, the reporting organization was not subject to any examination by a taxing authority.
