The purpose of the Public Interest Law Project is (1) to render legal services to low income persons who may be in need thereof and are financially unable to pay for the same; and (2) to provide technical assistance, training, research, and litigation support to public interest law programs and community based organizations on law and policy issues related to housing and community development, public benefits, health, education, welfare, and civil, consumer and economic rights.

It focuses on increasing access to general assistance benefits - the income support of last resort for all counties in California when no other safety net program is available. Many counties, disproportionately rural ones, have grossly inadequate programs serving exceedingly small numbers of people despite burgeoning homelessness. And even those persons receiving benefits do not receive the proper amount promptly and humanely. The project works with advocates in local public interest law programs that have identified illegal aspects of their county GA program. |

We represent the Kennedy Commission and four individual residents of a residential motel (Costa Mesa Motor Inn) in a writ proceeding and complaint for declaratory and injunctive relief challenging Costa Mesa's land use approvals for the development of a luxury apartment complex on the site of the Motor Inn. In 2017 we won a judgement in the trial court finding that the City's land use approvals had violated various state laws, which resulted in a settlement in which, among other things, a fund to pay the relocation and comparable replacement housing costs for tenants displaced from the Motor Inn. |

The City's housing element for the 2008-2013 housing element planning period required the City to re-zone 91 acres to high density in order to comply with state law. The City refused to do re-zone as a result of anti-housing opposition. The City then failed adopt a revised element for the 2013-2021 planning period to accommodate its assigned share of the regional need for affordable housing. When it finally submitted a tardy draft to the state Department of Housing and Community Development, the department found the need to re-zone 191 acres to high density which would accommodate over 4500 new multi-family units. The City failed and on behalf of lower income residents PILP and local legal services counsel filed this litigation. The suit resulted stipulated judgment requiring the City to accomplish the rezoning for affordable housing. |
