Mission

Pacific legal foundation litigates nationwide to secure all americans' inalienable rights to live responsibly and productively in their pursuit of happiness. Plf combines strategic and principled litigation, communications, and research to achieve landmark court victories enforcing the constitution's guarantee of individual liberty.

Major Activities

Activity 2
Public education:plf's successes in courtrooms across america generate legal precedents for liberty. They also generate headlines in the media, interest among our donors, and enlighten those who are unaware of plf's pro-freedom mission. In 2012 plf used a comprehensive program of focused media relations, web, and direct public outreach to communicate plf's key messages and mission to help people understand how and why our litigation changes people's lives. The unanimous united states supreme court ruling in sackett v. Epa provided the impetus for national news coverage of this historic victory over the u.s. Environmental protection agency. Plf clients mike and chantell sackett, and plf attorney(s) were frequent guests on lou dobbs tonight (fox business channel), fox & friends (fox news channel) and other national media outlets. It's vitally important to reaffirm the value of donor contributions to plf's pro-freedom legal program, but also to educate and inform prospective new donors about plf's work, generate leads for potential new plf cases, and cultivate stronger relationships with the news media. Combining various marketing and communications elements - media relations, plf's web site, electronic and printed communications, social media, blogs, videos, podcasts, speeches, and advertising - plf gained wide media and public exposure in 2012.below are some additional highlights of this program: a combined search of lexis, westlaw and google news revealed more than 1,840 print media reports on plf. Plf attorneys and clients were featured in 88 broadcast news stories. 22 op-eds on plf's work were published. We distributed 59 press releases and news advisories. We had 251,135 pageviews to the plf web site. We also had 179,451 unique visitors. Our biggest months of the year for traffic were october (plf's enlist with matt sissel campaign), followed by march (sackett ruling), then january (sackett oral argument). Our "enlist with matt sissel" campaign generated 2,200 unique visitors to the plf web site. More than 75 percent were new visitors to our site, driven by paid advertising. The team completed 49 videos during 2012. We began weekly plf podcasts to enhance our outreach to the media and general public. Twenty-six podcasts were recorded and we had 2,180 downloads of the podcasts.plf staff participated in 68 events, giving speeches, participating in debates and panel discussions. These presentations reached an audience of more than 5,800 people. We conducted two rounds of advertising (siriusxm radio and online ads on reason.com, weekly standard, and national review sites) to promote our sissel challenge to obamacare in october and again post-election to highlight our sissel case as well as koontz case and challenges to environmental regulations. We promoted our status as a u.s. News and world report best law firms for 2011-2012 in rescuing liberty and on the plf web site.

STATE OF TEXAS - THE TEXAS SUPREME COURT ISSUED A FAVORABLE OPINION THAT OVERTURNS AN APPEALS COURT RULING FOR THE GOVERNMENT AND REMANDS THE CASE TO THE LOWER COURT TO RECONSIDER ITS DECISION IN LIGHT OF PLF'S SEVERANCE RULING (SEE BELOW). AFTER TROPICAL STORM FRANCES HIT THE TEXAS COAST IN 1998, ERODING BEACHES AND MOVING THE VEGETATION LINE LANDWARD OF SEVERAL HOMES, THE STATE CLAIMED THE RIGHT TO COMMENCE LEGAL ACTIONS TO REMOVE THE STRUCTURES. THE PROPERTY OWNERS COMMENCED A LAWSUIT ALLEGING THAT THE TEXAS OPEN BEACHES ACT EFFECTS A "TAKING" BY IMPOSING A PUBLIC EASEMENT ON THEIR PROPERTIES. PLF ATTORNEYS REPRESENTED SOME OF THE LANDOWNERS.(ORAL ARGUMENT 1/15/13) KOONTZ V. ST. JOHNS RIVER WATER MANAGEMENT DISTRICT - THE U.S. SUPREME COURT HEARD ORAL ARGUMENT IN THIS CASE IN WHICH PLF ATTORNEYS REPRESENT THE KOONTZ FAMILY, WHICH TRIED TO DEVELOP THEIR FLORIDA LAND, BUT WERE DENIED A PERMIT BY THE GOVERNMENT AFTER THEY REFUSED TO SUBMIT TO CONDITIONS REQUIRING THEM TO IMPROVE OFF-SITE PUBLIC INFRASTRUCTURE. THE CASE IS A FOLLOW-UP TO ANOTHER PLF SUPREME COURT CASE, NOLLAN V. CALIFORNIA COASTAL COMMISSION, WHICH HELD THAT THE UNITED STATES CONSTITUTION PROHIBITS GOVERNMENTS FROM IMPOSING EXTORTIONATE CONDITIONS ON PROPERTY OWNERS' RIGHT TO USE AND DEVELOP THEIR PROPERTIES. THE CASE CONSIDERS THE EXTENT TO WHICH NOLLAN SHOULD APPLY TO PROTECT PROPERTY OWNERS. KOONTZ IS THE EIGHTH PLF CASE TAKEN UP BY THE SUPREME COURT SINCE PLF'S FOUNDING IN 1973.(VICTORY 12/4/12) ARKANSAS GAME & FISH COMMISSION V. UNITED STATES - IN A MAJOR PROPERTY RIGHTS DECISION IN WHICH PLF PLAYED AN AMICUS ROLE, THE U.S. SUPREME COURT, IN AN 8-0 RULING, HELD THAT THE TAKINGS CLAUSE OF THE UNITED STATES CONSTITUTION PROTECTS AGAINST ALL GOVERNMENT INVASIONS OF PRIVATE PROPERTY, EVEN IF THE GOVERNMENT INTRUSION IS TEMPORARY IN DURATION. THE DECISION REVERSED A FEDERAL CIRCUIT COURT OF APPEALS OPINION THAT HAD AUTHORIZED THE GOVERNMENT TO TEMPORARILY FLOOD PRIVATE PROPERTY IN ARKANSAS WITHOUT PAYING JUST COMPENSATION TO THE OWNER(ADVERSE DECISION 7/26/12) HAGE V. UNITED STATES - THE ESTATE OF WAYNE HAGE WON $17 MILLION IN TAKINGS DAMAGES AND INTEREST AFTER THE UNITED STATES FOREST SERVICE RESTRICTED ACCESS TO WATER OWNED BY HAGE, DESTROYING THE VALUE OF THE CATTLE RANCHING OPERATION.
