Governance Explanations

Form 990, Part VI, Section B, Line 11B

The Board of Directors has delegated the review of form 990 to the Co-Executive Directors. The Co-Executive Director of Operations & Finance works closely with the outside Accounting Firm and engages to prepare the return. The Co-Executive Director of Organizing & Programs also reviews the final form 990. Once the review has been completed, the final form 990 is presented to the Board for action before the return is filed.

Form 990, Part VI, Section B, Line 15A

It is the intent of the LABWC Board and the Co-Executive Directors to compensate all employees in a manner that is fair, reasonable, competitive, and fiscally prudent with respect to budget and funding. The goal of the LABWC continues to be to attract, motivate, and retain the most highly qualified individuals to serve as staff and directors whose knowledge, experience, and contributions can advance LABWC's mission. The LABWC adheres to fair and equitable design, application, and delivery compensation practices. Implementation: the LABWC will consistently evaluate competitive and fair compensation for all employees based on periodic market comparison surveys and an individual employee's depth of skill and experience. In addition, the LABWC will maintain and update annually a tiered list of non-profit industry-specific and comparison institutions for applicable employee groups. The list may consider geographic location, enrollment, budget, research funding, and other appropriate variables. Compensation will be guided with reference to the mean and/or median of the appropriate tier of comparison institutions, an individual's reputation, length, depth, and effectiveness of applicable experience, and other commendable achievements and contributions to the success of the LABWC. The compensation system for the LABWC shall (a) be administered in a manner that complies with all applicable federal, state, and local regulations and Laws and (b) be consistent with applicable administrative policies and rules.

Financial Statement Notes

Part X : FIN48 Footnote

LABWC is exempt from Federal income taxes under Section 501(c)(3) of the Internal Revenue Code and California income taxes under section 23701(d) of the California Revenue and Taxation Code. LABWC is required to pay an annual filing fee to the State of California and other states it operates in.LABWC has adopted Financial Accounting Standards Board Accounting Standards Codification (ASC) Section 740-10, which clarifies the accounting for uncertainty in income taxes. ASC Section 740-10 prescribes a recognition threshold and measurement attribute for the financial statement recognition and measurement of a tax position taken or expected to be taken in a tax return. ASC Section 740-10 requires that an organization recognize in the financial statements the impact of the tax position if that position will more likely than not be sustained on audit, based on the technical merits of the position. As of and for the year ended June 30, 2025, LABWC had no material unrecognized tax benefits, tax penalties or interest.LABWCs Forms 990, Return of Organization Exempt from Income Tax, for each of the tax years ended June 30, 2024, 2023, and 2022, are subject to examination by the IRS, generally for 3 years after they were filed.LABWCs Forms 199, California Exempt Organization Return, for each of the tax years ended June 30, 2024, 2023, and 2022, are subject to examination by the Franchise Tax Board, generally for 4 years after they were filed.

We achieve this by advocating for equitable policies and meaningful direct placements. Our program prepares Black workers for high-road career opportunities by partnering with unions and employers. But our commitment continues beyond there. We offer a robust support system, including industry mentorship, peer support groups, and occupational coaching. This comprehensive network is designed to help participants navigate work/life challenges and troubleshoot problems that may arise during employment.

We do that by supporting Black Worker Centers in Los Angeles, the Inland Empire and San Diego as they fight for economic inclusion and opportunity for the region's Black workers. A 2024 WorkSafe Health & Safety award recipient, the Hub has contacted thousands of Black workers to share life saving occupational health and safety information.
