The Botanical Gardens is exempt from federal income taxes under Section 501(c) (3) of the Internal Revenue Code, and therefore, no provision for federal income taxes is included. In addition, the Botanical Gardens has been classified as an organization that is not a private foundation under Section 509 (A) (2). The Organization's Forms 990, Return of Organization Exempt from Income Tax, for the years ending 2013, 2014, 2015 and 2016 are subject to examination by the internal Revenue Service, generally for 3 years after they were filed.
