FIRST, THE CHARITY SATISFIES THE THRESHOLD CRITERIA IN THE REGULATIONS; IT NORMALLY RECEIVES AT LEAST 10% OF ITS SUPPORT FROM THE GENERAL PUBLIC, AND IT CARRIES ON A CONTINUOUS AND BONA FIDE PROGRAM OF SOLICITATION OF PUBLIC SUPPORT. MOREOVER, THE ALLIANCE FOR EDUCATION SOLUTIONS MEETS THE FOLLOWING FACTORS ENUMERATED IN THE REGULATIONS AS BEING INDICATIVE OF PUBLIC SUPPORT:1. PERCENTAGE OF FINANCIAL SUPPORT (TREAS. REG. 1.170A-9(F)(3)(III)(A)). DURING THE FIVE-YEAR PERIOD ENDING ON DECEMBER 31, 2014, THE PORTION OF THE ALLIANCE FOR EDUCATION SOLUTIONS SUPPORT THAT QUALIFIES AS ELIGIBLE PUBLIC SUPPORT IS JUST OVER 22% (SEE SCHEDULE A)-WELL IN EXCESS OF THE 10% THRESHOLD.2. SOURCES OF SUPPORT (TREAS. REG. 1.170A-9(F)(3)(III)(B)). OVER THE PAST DECADE, THE EDUCATIONAL SYSTEM HAS EMPHASIZED HIGH STAKES TESTING, CURRICULUM REFORM AND ZERO TOLERANCE DISCIPLINARY POLICIES. THESE STRATEGIES HAVE BEEN LARGELY INEFFECTIVE IN MEETING THE EDUCATIONAL NEEDS OF POOR STUDENTS AND STUDENTS OF COLOR, AND THEY HAVE DIVERTED ATTENTION AND PUBLIC FUNDING FROM REFORM EFFORTS LIKE OURS FOCUSED ON IMPROVING THE QUALITY OF LEARNING ENVIRONMENTS AND INCLUDING YOUTH VOICE IN EDUCATIONAL DECISION-MAKING. BECAUSE WE CONSIDER SUCH FACTORS TO BE CENTRAL FOR IMPROVING EDUCATIONAL OUTCOMES FOR OUR MOST VULNERABLE STUDENTS, WE HAVE PRESSED ON WITH FUNDING FROM THE DAVITTO CHARITABLE REMAINDER TRUST. THAT STRATEGY HAS ALLOWED US TO CARRY OUT DEMONSTRATION PROJECTS IN AREAS THAT ARE NOW DRAWING THE ATTENTION OF FUNDERS AND LEAVE US WELL POSITIONED TO DEVELOP NEW FUNDING SOURCES. IN 2015 TWO PUBLIC ENTITIES, CALIFORNIA STATE UNIVERSITY, CHICO AND THE SAN JUAN UNIFIED SCHOOL DISTRICT ARE PICKING UP PROGRAM COSTS PREVIOUSLY BORNE SOLELY BY AES, AND THE ARATA BROTHERS TRUST HAS PROVIDED A GRANT TO EXPAND THE DISSEMINATION OF OUR DOCUMENTARY FILM, LEADING WITH HEART: PRINCIPALS WHOSE SCHOOLS SUCCEED, WHICH HAS BEEN SHOWN AT A NUMBER OF EDUCATION CONFERENCES AND HAS BEEN USED BY RELWEST AND WESTED WORKSHOPS TO MUCH ACCLAIM. WE ARE CURRENTLY HAVING VERY ENCOURAGING DISCUSSIONS WITH THE SIERRA HEALTH FOUNDATION (A PREVIOUS AES FUNDER) AND THE CALIFORNIA ENDOWMENT. BOTH HAVE EXPRESSED INTEREST IN FUNDING SEVERAL OF OUR PROJECTS AND HAVE ENCOURAGED US SUBMIT FORMAL FUNDING PROPOSALS. NATIONALLY, WE ARE ALSO EXPLORING PARTNERSHIPS WITH SPARK ACTION, OPPORTUNITY YOUTH UNITED, AND THE NATIONAL CONFERENCE OF YOUTH LEADERS - WELL-FUNDED ORGANIZATIONS WHOSE VALUES AND GOALS CLOSELY ALIGN WITH OUR OWN.3. REPRESENTATIVE GOVERNING BODY (TREAS. REG. 1.170A-9(F)(3)(III)(C)). THE ALLIANCE FOR EDUCATION SOLUTIONS IS GUIDED BY A BOARD OF PROFESSIONALS, BUSINESS AND COMMUNITY LEADERS. THESE INDIVIDUALS ARE EXPERTS IN THEIR FIELD; REPRESENT A BROAD CROSS-SECTION OF THE VIEWS AND INTERESTS OF THE COMMUNITIES THAT THE ALLIANCE FOR EDUCATION SOLUTIONS SERVES; AND ARE EMINENTLY QUALIFIED TO ENSURE THAT THE ORGANIZATION OPERATES FOR THE INTERESTS OF THE PUBLIC, AS OPPOSED TO THE PERSONAL OR PRIVATE INTERESTS OF ANY PARTICULAR DONOR. 4. AVAILABILITY OF PUBLIC SERVICES; PUBLIC PARTICIPATION IN PROGRAMS OR POLICIES (TREAS. REG. 1.170A-9(F)(3)(III)(D)). THE ALLIANCE FOR EDUCATION SOLUTIONS PRIMARY EXEMPT PURPOSE IS TO PROVIDE A SOLUTION-FOCUSED, RESEARCH-BASED ADVOCACY AND INTERMEDIARY ORGANIZATION. THEY ARE COMMITTED TO WORKING COLLABORATIVELY TO CREATE THE CONDITIONS FOR HIGH QUALITY LEARNING ENVIRONMENTS IN CALIFORNIA SCHOOLS TO IMPROVE STUDENT EDUCATIONAL AND LIFE OUTCOMES.
