Mission

Farmworker justice fund, inc. Is a non-profit corporation established under the laws of the district of columbia. Its mission is to empower migrant and seasonal farmworkers to improve their wages, working conditions, occupational safety, health, immigration status, and access to justice through litigation, advocacy, public awareness, capacity building, coalition building, and support for union organizing.

Governance Explanations

Form 990, Part VI, Section B, Line 11

The draft form 990 was prepared by the outside accountants and reviewed by senior management. The finance committee and the full board received a copy of the draft 990 and the audited financial statements. The board members reviewed the forms and statements and forwarded any questions through the finance committee to the president. After the finance committee members were satisfied with the responses, they then responded to the board. Once this process was completed, the 990 was filed with the irs.

Form 990, Part VI, Section B, Line 12C

The organization regularly and consistently monitors and enforces its conflict of interest policy by requiring each board member to complete an annual statement and employees to sign a statement upon hiring. By signing this form, the individual affirms that he/she has no conflicts of interest with the organization or discloses any such situations that may arise. If a conflict of interest arises, the conflicted board member recuses him/herself from discussion and resolution of the issue by the board.

Form 990, Part VI, Section B, Line 15A

The organization's process for determining the president's compensation includes: 1) annually, the board writes a performance evaluation for the president. 2) the vice chair meets with the personnel committee to compile the performance evaluations. 3) the personnel committee discusses comparable information from unrelated organizations where they and other board members serve. 4) the personnel committee makes salary recommendations to the full board who vote on any salary increases. Only board members who are independent of the officers may participate in determining the president's and other officers' compensation. 5) the personnel committee keeps minutes to document the entire evaluation, deliberation, and decision process. The last compensation review took place in may 2013.

However, the organization maintains a collaborative relationship with and is a subsidiary corporation of the national council of la raza (nclr), a not-for-profit corporation incorporated in washington, d.c. This relationship was established through an election under d.c. Law. The farmworker justice management and board of directors are independent of the nclr management and board of directors.

For the years ended december 31, 2013 and 2012, the organization has documented its consideration of fasb asc 740-10, income taxes, that provides guidance for reporting uncertainty in income taxes and has determined that no material uncertain tax positions qualify for either recognition or disclosure in the financial statements. The federal form 990, return of organization exempt from income tax, is subject to examination by the internal revenue service, generally for three years after it is filed.
