PART X, LINE 2:

The organization is a nonprofit organization that is exempt from income taxes under section 501(c)(3) of the internal revenue code. The internal revenue service has determined that the organization is not a private foundation within the meaning of section 509(a). The income taxes topic of fasb asc 740 clarifies the accounting for uncertainty in income taxes recognized in an enterprise's financial statements. Asc 740 requires an enterprise to disclose the nature of uncertain tax positions taken, if any, when filing its income tax return utilizing a two-step process to recognize and measure any uncertain tax positions taken. The entity recognizes a tax benefit only if it is more likely than not the position would be sustained in a tax examination, with a tax examination being presumed to occur. No tax benefit will be recorded on tax positions not meeting the more likely than not test. Interest and penalties accrued or incurred, if any, as a result of applying asc 740 will be recorded to interest expense and other expense, respectively. Based on its evaluation, the organization has concluded that there are no uncertain tax positions requiring recognition in its financial statements. The organization's evaluation was performed for all federal and state tax periods still subject to examination. The organization and its acquiree's 2011 through 2013 federal and state exempt organization returns remain subject to examination by the irs and the state taxing authority.

HEA ADULT EDUCATION IS SUPPORTED BY A GRANT THROUGH THE INDIANA DEPARTMENT OF WORKFORCE DEVELOPMENT (IDWD) AND AN ENDOWMENT MANAGED BY THE ELKHART COUNTY COMMUNITY FOUNDATION. AS A STATE-FUNDED ADULT EDUCATION PROGRAM, HEA MEETS THE PERFORMANCE REQUIREMENTS OF THE STATE AND IS PART OF THE INDIANA REGION 2 ADULT EDUCATION CONSORTIUM. THIS ENSURES HIGH QUALITY PROGRAMMING FOR ADULT LEARNERS. HEA IS CURRENTLY THE ONLY PROGRAM IN THE INDIANA REGION 2 (5-COUNTIES IN NORTHERN INDIANA) THAT OFFERS HIGH SCHOOL EQUIVALENCY PREPARATION IN SOLELY A DISTANCE LEARNING SETTING. HEA'S COMPLETION RATE IS ONE OF THE HIGHEST IN THE REGION, WITH OVER 20% SUCCESSFULLY ATTAINING THEIR HSE. IRS990/ProgSrvcAccomActy2Grp/Desc0HEA HAS RECEIVED STRONG SUPPORT FROM THE ELKHART COUNTY COMMUNITY FOUNDATION TO LAUNCH INNOVATIVE POPULATION-LEVEL AND FOCUSED EDUCATIONAL INITIATIVES IN COLLABORATION WITH MULTIPLE COMMUNITY BASED ORGANIZATIONS AND THE SEVEN ELKHART COUNTY PUBLIC SCHOOL SYSTEMS. DURING 2015 HEA EXPANDED AND DEEPENED THE IMPLEMENTATION OF EVIDENCE-BASED PROGRAMS ACROSS THE AGE SPAN. BECAUSE OF ITS SUCCESS, TOOLS OF THE MIND WAS EXPANDED TO 20 KINDERGARTEN CLASSROOMS IN TWO ELKHART COUNTY SCHOOL SYSTEMS. THIRTY-NINE TEACHERS WERE TRAINED TO IMPLEMENT THE PAX GOOD BEHAVIOR GAME, INCREASING THE NUMBER OF FIRST GRADE TEACHERS PREPARED TO PROVIDE SELF-REGULATION TRAINING TO YOUNG STUDENTS IN ELKHART COUNTY. SIXTY CLASSROOMS REPRESENTING ALL SEVEN SCHOOL SYSTEMS IN THE COUNTY PARTICIPATED IN PAX WEEK, IN MARCH OF 2015. THIS WEEK, SPONSORED BY HEA, FOCUSED ON FULLY IMPLEMENTING CLASSROOMS, WITH THE GOALS OF INCREASING AWARENESS OF PAX AND SUPPORTING TEACHERS IN THEIR IMPLEMENTATION STRATEGIES. HEA CONTINUES TO SUPPORT THE IMPLEMENTATION OF EARLY COLLEGE HIGH SCHOOL IN ELKHART COUNTY. IN 2015 HEA CONVENED BUSINESS EDUCATION ROUNDTABLES IN SIX SCHOOL DISTRICTS WITH OVER 100 BUSINESSES PARTICIPATING TO BRING REAL WORLD PROBLEMS INTO HIGH SCHOOL CLASSROOMS AND GIVE STUDENTS THE OPPORTUNITY TO EXPLORE THE WORLD OF WORK. HEA HELPED TO FUND AND ORGANIZE PROJECT BASED LEARNING (PBL) TRAINING FOR 60 ELKHART COUNTY HIGH SCHOOL TEACHERS. ALL OF THIS EFFORT WILL STRENGTHEN THE EARLY COLLEGE AND POLYTECHNIC PROGRAMS IN THE HIGH SCHOOLS CREATING AN ENVIRONMENT WHERE STUDENTS ARE ENGAGED AND FUTURE THINKING. FINALLY, HEA, IN COLLABORATION WITH CHILD AND PARENT SERVICES (CAPS) LAUNCHED THE TRIPLE P POSITIVE PARENTING PROGRAM, AN EVIDENCE-BASED POPULATION-LEVEL PROGRAM THAT SUPPORTS PARENTS AND GIVES THEM TOOLS TO PROVIDE NURTURING ENVIRONMENTS FOR THEIR CHILDREN. FIFTY-ONE LOCAL PRACTITIONERS WERE TRAINED TO PROVIDE TRIPLE P TO THE PARENTS IN ELKHART COUNTY. SINCE COLLECTIVE ACTION AND POPULATION LEVEL PROGRAMMING ARE NECESSARY STRATEGIES TO ACHIEVE HEA'S VISION THAT "ELKHART COUNTY IS A WORLD CLASS PLACE TO LEARN, LIVE, WORK AND PLAY," IN 2015 HEA'S BOARD OF DIRECTORS ESTABLISHED A STANDING IMPACT COMMITTEE TO PROVIDE SUSTAINED LEADERSHIP IN THE DEVELOPMENT OF METRICS THAT MEASURE OUR PROGRESS TOWARD THIS VISION. DURING 2015 THE HEA STAFF WORKING WITH THE COLUMBUS INDIANA-BASED INSTITUTE FOR COALITION BUILDING, BEGAN TO DEVELOP NETWORKS THAT ALIGN WITH THE LIFE SPAN AREAS WHICH HAVE BEEN HEA'S FOCUS. WHILE COLLABORATIVE EVIDENT-BASED PROGRAMMING CAN CREATE A SIGNIFICANT IMPACT IN A COMMUNITY, IT WILL TAKE EVERYONE WORKING TOGETHER TO BRING ABOUT THE TRANSFORMATIVE CHANGE THAT HEA AND ELKHART COUNTY ARE SEEKING. AS THE HEA MISSION STATEMENT ELOQUENTLY EXPRESSED: HEA EXISTS TO CREATE COLLABORATION, INCREASE INNOVATION AND MOVE EVERYONE FROM HOPE TO BELIEF THAT ELKHART WILL BE TRANSFORMED THROUGH EDUCATION. THESE NETWORKS WILL MOBILIZE MULTIPLE STAKEHOLDERS ACROSS THE COUNTY TO ADDRESS THE LEARNING NEEDS OF CHILDREN AND ADULTS ACROSS THE LIFESPAN.

THE INTERNAL REVENUE SERVICE HAS DETERMINED THAT THE ORGANIZATION IS NOT A PRIVATE FOUNDATION WITHIN THE MEANING OF SECTION 509(A). THE INCOME TAXES TOPIC OF FASB ASC 740 CLARIFIES THE ACCOUNTING FOR UNCERTAINTY IN INCOME TAXES RECOGNIZED IN AN ENTERPRISE'S FINANCIAL STATEMENTS. ASC 740 REQUIRES AN ENTERPRISE TO DISCLOSE THE NATURE OF UNCERTAIN TAX POSITIONS TAKEN, IF ANY, WHEN FILING ITS INCOME TAX RETURN UTILIZING A TWO-STEP PROCESS TO RECOGNIZE AND MEASURE ANY UNCERTAIN TAX POSITIONS TAKEN. THE ENTITY RECOGNIZES A TAX BENEFIT ONLY IF IT IS MORE LIKELY THAN NOT THE POSITION WOULD BE SUSTAINED IN A TAX EXAMINATION, WITH A TAX EXAMINATION BEING PRESUMED TO OCCUR. NO TAX BENEFIT WILL BE RECORDED ON TAX POSITIONS NOT MEETING THE MORE LIKELY THAN NOT TEST. INTEREST AND PENALTIES ACCRUED OR INCURRED, IF ANY, AS A RESULT OF APPLYING ASC 740 WILL BE RECORDED TO INTEREST EXPENSE AND OTHER EXPENSE, RESPECTIVELY. BASED ON ITS EVALUATION, THE ORGANIZATION HAS CONCLUDED THAT THERE ARE NO UNCERTAIN TAX POSITIONS REQUIRING RECOGNITION IN ITS FINANCIAL STATEMENTS. THE ORGANIZATION'S EVALUATION WAS PERFORMED FOR ALL FEDERAL AND STATE TAX PERIODS STILL SUBJECT TO EXAMINATION. THE ORGANIZATION AND ITS ACQUIREE'S 2011 THROUGH 2013 FEDERAL AND STATE EXEMPT ORGANIZATION RETURNS REMAIN SUBJECT TO EXAMINATION BY THE IRS AND THE STATE TAXING AUTHORITY.
