Mission and Program Overview

Mission

Southeastern North Dakota Community Action Agency (SENDCAA) was formed in 1965 to provide a range of services and activities in a six county area designed to alleviate poverty and give low-income people the opportunity to improve their standard of living and achieve self-sufficiency. Areas of service or program operation include food, clothing, shelter, housing, head start child education, child care, energy conservation and individualized support services. Its major sources of revenue consist of various federal, state and other grants.

The Executive Director & Finance Director review the Form 990. It is then provided to the Board for their review before it is filed with the IRS.

Form 990, Part VI, Section B, line 12C

Annually the Board Members and the Executive Director review the policy and complete a conflict of interest statement. The Executive Director reviews these disclosures. The President of Board reviews the Executive Director's. If a potential conflict is disclosed the Executive Director provides this to the Board President. The Board President presents the potential conflict to board, at which time the individual with the potential conflict abstains from voting on decisions related to the conflict.

Form 990, Part VI, Section B, line 15A

Annually the Board of Directors review the compensation for the Executive Director using comparability data of other area organizations of similar size, as well as other similar regional agencies. The deliberation and decision is documented in the board minutes. There are no other officers or key employees of the organization.

The organization makes its governing documents, conflict of interest policy, and financial statements available upon request.

Part VII, Executive Director Compensation:

SENDCAA issues the W2 for the Executive Director's compensation for services provided to both SENDCAA and Region V Community Development Corp (RVCDC). RVCDC, a related nonprofit organization, reimburses SENDCAA for the services James Kappel provides RVCDC as their Executive Director. The compensation reflected in Part VII from the related organization reflects the amount reimbursed by RVCDC. In addition to this reimbursed amount, in 2018 RVCDC provided an incentive management payment to James Kappel for services solely to RVCDC, and RVCDC issued a separate 2018 W2 for that amount.

Financial Statement Notes

Part X, Line 2:

SENDCAA is organized as a North Dakota nonprofit corporation and has been recognized by the Internal Revenue Service (IRS) as exempt from federal income taxes under Section 501(a) of the Internal Revenue Code as an organization described in Section 501(c)(3), qualifies for the charitable contribution deduction under Section 170(b)(1)(A)(vi). The entity is annually required to file a Return of Organization Exempt from Income Tax (Form 990) with the IRS. In addition, the entity is subject to income tax on net income that is derived from business activities that are unrelated to its exempt purposes. The entity has determined it is not subject to unrelated business income tax and has not filed an Exempt Organization Business Income Tax Return (Form 990-T) with the IRS. The entity believes that it has appropriate support for any tax positions taken affecting its annual filing requirements, and as such, does not have any uncertain tax positions that are material to the financial statements. The entity would recognize future accrued interest and penalties related to unrecognized tax benefits and liabilities in income tax expense if such interest and penalties are incurred.

The entity is annually required to file a Return of Organization Exempt from Income Tax (Form 990) with the IRS. In addition, the entity is subject to income tax on net income that is derived from business activities that are unrelated to its exempt purposes. The entity has determined it is not subject to unrelated business income tax and has not filed an Exempt Organization Business Income Tax Return (Form 990-T) with the IRS. The entity believes that it has appropriate support for any tax positions taken affecting its annual filing requirements, and as such, does not have any uncertain tax positions that are material to the financial statements. The entity would recognize future accrued interest and penalties related to unrecognized tax benefits and liabilities in income tax expense if such interest and penalties are incurred.
