Financial Statement Notes

Part X, Line 2:

The Fund is exempt from income taxes under Section 501(c)(3) of the Internal Revenue Code and Section 23701(d) of the California Revenue and Taxation Code. Accordingly, no provision for income taxes has been recorded in the accompanying financial statements related to the Fund. Pursuant to FASB Accounting Standards Codification (ASC) 740-10, Income Taxes, the Fund would recognize the tax benefit from uncertain tax positions only if it is more likely than not that the tax positions will be sustained on examination by the tax authorities, based on the technical merits of the position. The tax benefit is measured based on the largest benefit that has a greater than 50% likelihood of being realized upon ultimate settlement. As of December 31, 2015 and 2014, the Fund had no uncertain tax positions requiring accrual. The Fund is currently under an IRS tax examination for the 2014 and 2013 tax years.

Accordingly, no provision for income taxes has been recorded in the accompanying financial statements related to the Fund. Pursuant to FASB Accounting Standards Codification (ASC) 740-10, Income Taxes, the Fund would recognize the tax benefit from uncertain tax positions only if it is more likely than not that the tax positions will be sustained on examination by the tax authorities, based on the technical merits of the position. The tax benefit is measured based on the largest benefit that has a greater than 50% likelihood of being realized upon ultimate settlement. As of December 31, 2015 and 2014, the Fund had no uncertain tax positions requiring accrual. The Fund is currently under an IRS tax examination for the 2014 and 2013 tax years.

Completed applications are returned to the General Manager or sent directly to the CPK Kindness Fund. Qualifying applicants are awarded up to $5,000 per catastrophe. Prioritization of the fund allocations are: 1) death, 2) emergency shelter, 3) accident/injury and 4) aid & assistance. The CPK Kindness Fund Committee consists of management members including a Regional Partner and various Restaurant Support Center employees. The Committee is authorized to determine the disbursement of the funds, and all requests are kept confidential. The Committee meets monthly or as needed to review and discuss any requests received. Majority vote is required to approve assistance. Funds are distributed via payments to third parties based on grant application. It will be the sole responsibility of the Committee and the Fund to ensure the funds granted to employees are used appropriately. CPK employees will provide supporting documentation of the party the funds will be paid to and the Committee verifies the information before funds are distributed. Any exceptions to this procedure will be rare and will be tracked accordingly.
