Governance Explanations

Form 990, Part VI, Section B, Line 11B

Upon completion of the draft tax return, it is reviewed in its entirety by the fire relief's treasurer. After comments are updated on the draft return, the return is finalized and filed. The as-filed form 990 is presented to the board and discussed at the first board meeting after filing.

Form 990, Part VI, Section B, Line 12

Per minnesota state statute, each member of the governing board of a covered pension plan and the chief administrative officer of the plan shall file with the plan a statement of economic interest. The statement must contain information that the governing board of the plan determines is necessary to disclose a reasonably foreseeable potential or actual conflict of interest. Information such as the individual's principal occupation, place of business, ownership greater than 10% of a business or any relationship or financial arrangement are addressed on the form. If a conflict of interest is noted the governing board will take action to ensure all proper steps are followed. This statement must be filed annually. The current year statements were obtained from all necessary individuals, were noted to be completed properly, and noted no conflict of interest for the andover firefighter's relief association governing board.

Several members of the board of trustees are nonvoting members. Minnesota state statue 424a.04 subd. 1 requires three ex officio members in addition to the six elected members. The three ex officio members include the chief of the fire department and two additional officials of the municipalities served by the association.

The board of trustees of the association provides oversight of the audit, financial reports, and selection of the independent auditor. This process has not changed from the prior year.

Financial Statement Notes

PART X, LINE 2:

The association is a tax exempt organization under internal revenue code 501(c)(4). The association is subject to a tax on income from any unrelated business. The association is subject to the recognition requirements for uncertain income tax positions as required by the financial accounting standards board accounting standards codification 740-10. Income tax benefits are recognized for income tax positions taken or expected to be taken in a tax return, only when it is determined that the income tax position will more-likely-than-not be sustained upon examination by taxing authorities. The association has analyzed tax positions taken for filing with the internal revenue service and state jurisdiction where it operates. The association believes that income tax filing positions will be sustained upon examination and does not anticipate any adjustments that would result in a material adverse effect on the association's financial condition, results of operations, or cash flows. Accordingly, the association has not recorded any reserves, or related accruals for interest and penalties for uncertain income tax positions at year-end. The association is subject to routine audits by taxing jurisdictions; however, there are currently no audits in progress for any open tax periods.
