Bet tzedek's audit committee meets with the ceo and cfo to discuss the draft of the form 990. Once accepted, the form is made available to the entire board of directors for review. The return is then electronically filed.

The executive and governance committees, with input from senior management, monitor the conflict of interest policy on an ongoing basis. Each september, at the start of the organization's fiscal year, each board member is asked to review and sign the conflict of interest policy. The conflict of interest policy articulates when a board member must disclose a conflict of interest and recuse themselves from any board discussion or decision-making process related to that interest.

Financial Statement Notes

PART V, LINE 4:

The organization has adopted investment and spending policies for endowment assets that attempt to provide a predictable stream of funding to programs supported by its endowment while seeking to maintain the purchasing power of the endowment assets. Endowment assets include those assets of donor-restricted funds that the organization must hold in perpetuity or for a donor-specified period(s) as well as board-designated funds. Under this policy, as approved by the board of trustees, the endowment assets are invested in a manner that is intended to produce total returns (net of inflation) in excess of the endowment spend-out rate, thus allowing for real growth of endowment assets while assuming a moderate level of investment risk.

PART X, LINE 2:

The organization is exempt from federal income and california franchise taxes under section 501(c)(3) of the internal revenue code and the corresponding sections of the california revenue and taxation code. In accordance with financial accounting standards board ("fasb") accounting standards codification ("asc") topic no. 740, "uncertainty in income taxes" ("asc 740"), the organization recognizes the impact of tax positions in the financial statements if that position is more likely than not to be sustained on audit, based on the technical merits of the position. To date, the organization has not recorded any uncertain tax positions. During the year ended august 31, 2021, the organization performed an evaluation of uncertain tax positions and did not note any matters that would require recognition in the financial statements of which may have an effect on its tax-exempt status. The organization's income tax returns remain subject to examination for all tax years ended on or after august 31, 2017 with regard to all tax positions and the results reported.

PART XI LINE 2B AND PART XII LINE 2A:

Nationally recognized for its pro bono model, bet tzedek leverages the donated services of thousands of volunteers to dramatically increase the impact of its staff's work. Donated services and use of facilities in the amount of $4,824,888 is comprised of $1,043,696 in donated subscriptions and $3,781,192 in donated services. Donated subscriptions are recorded at their fair value when an unconditional promise to give has been made or when subscriptions have been received. The value of the donation is based on appraisal and other objective bases for determining the value or, in certain instances, based on management's best estimate of the fair value. Donated services are comprised of in-kind support for contributed professional services of volunteer attorneys, paralegals and law clerks for services received from the external and internal legal professionals based on the fiscal year. Donated services are valued at rates normally charged by the volunteers for similar services. In fiscal year 2021, bet tzedek received 17,843 hours of donated services that were provided as part of case work overseen by bet tzedek attorneys, paralegals, and law students.

BET TZEDEK CLIENTS BENEFIT FROM TWO DISTINCT VOLUNTEER GROUPS. THE FIRST ARE COMMUNITY VOLUNTEERS WHO PERFORM INTAKE INTERVIEWS AND OTHER CLIENT SERVICES, INCLUDING UP TO 150 LAW STUDENTS A YEAR. IN FISCAL YEAR 2021, THESE VOLUNTEERS DONATED THOUSANDS OF HOURS OF THEIR TIME, THE VALUE OF WHICH EXCEEDS $3 MILLION AND IS INCLUDED IN THE DONATED SERVICES STATEMENT IN THESE AUDITED FINANCIALS (SEE NOTE 2 "DONATED SUBSCRIPTIONS AND SERVICES"). (CONTINUED ON SCHEDULE O)THIS VALUATION IS LOWER THAN PREVIOUS YEARS DUE TO THE AGENCY CONTINUING TO OPERATE UNDER A REMOTE WORK STRUCTURE, WHICH IMPACTED THE ABILITY OF SOME VOLUNTEERS TO ASSIST ON CERTAIN TASKS. IN ADDITION TO THE VALUE THAT IN HOUSE VOLUNTEERS PROVIDE OUR COMMUNITIES, BET TZEDEK ALSO PLACES CLIENTS' CASES WITH HUNDREDS OF PRO BONO ATTORNEY AND PARALEGAL VOLUNTEERS AT LAW FIRMS NATIONWIDE. THESE PRO BONO VOLUNTEER HOURS ARE REPORTED TO THE ORGANIZATION AFTER THE END OF EACH YEAR, AND AS A RESULT THE 2021 AMOUNTS WILL BE DISCLOSED IN THE FINANCIAL STATEMENTS FOR THE FISCAL YEAR ENDING AUGUST 31, 2022. WHAT IS AVAILABLE IS THE TOTAL CONTRIBUTION MADE IN CALENDAR YEAR 2020: 34,065 HOURS OF SERVICE BY 1,109 VOLUNTEERS, WITH A VALUE ESTIMATED AT OVER $9 MILLION. BET TZEDEK'S EFFORTS IN MARSHALLING VOLUNTEERS AND PRO BONO LAWYERS IN INNOVATIVE AND IMPACTFUL WAYS HAVE RESULTED IN BET TZEDEK RECEIVING THE AMERICAN BAR ASSOCIATION'S "PRO BONO PUBLICO AWARD" FOR ITS HOLOCAUST SURVIVOR JUSTICE NETWORK, A NATIONAL NETWORK OF PRO BONO ATTORNEYS AND SOCIAL WORKERS REPRESENTING SURVIVORS IN THEIR APPLICATION FOR REPARATIONS IN OVER 30 CITIES.
