Financial Statement Notes

PART V, LINE 4:

The organization's term endowment funds are subject to donor-imposed stipulations that may be fulfilled by the actions of the board of directors or become unrestricted at the date specified by the donor. The endowments were created with the intent to support the operating expenses of artsquest including the costs to operate and maintain its building and campuses.

PART X, LINE 2:

The internal revenue service recognizes artsquest, the foundation, and the pavilion as exempt from income taxes under section 501(c)(3) of the internal revenue code and similar state provisions. Income from activities not directly related to these organization's tax-exempt purpose, if any, would be subject to taxation as unrelated business income. Media is a limited partnership ("lp") through which all net profits and net losses are allocated to the partners of the lp. As such, all earnings and losses are reported on the federal and state returns of the company's partners. Accordingly, no provision for income taxes is included in the accompanying consolidated financial statements. The organization complies with the guidance for uncertainty in income taxes using the provisions of fasb asc 740, income taxes. Using that guidance tax positions initially need to be recognized in the financial statements when it is more-likely-than-not the position will be sustained upon examination by tax authorities.
