Governance Explanations

Form 990, Part VI, Section A, Line 4

Summary of 2024 bylaw amendments article vii (elections): added "honorary chief" designation for 50-year members and clarified annual election procedures and nomination rules. Article xiii (deportment): updated quarterly achievement standards (33 points per quarter) and enforcement procedures. Article xii (committees): added new discipline committee and formalized appeal process. Article iii (membership): clarified rights of honorary and life members accepted after jan 1 2024. Article xiv (reinstatement & transfers): allowed life members to re-enter active service with conditions.

Form 990, Part VI, Section A, Line 6

The limit of the active membership in the fire company shall be one hundred (100) members. The albertson fire company shall have three classifications of its members. They are active, honorary and life as defined further in article 3 of these by-laws. All members shall be limited to one classification. Any life/honorary member accepted after january 1 2024 shall be able to attend all fire company functions, maintain a key, badge, uniform and id. Card. All active members with a combination of 25 years in the fire service (regardless of department) and having reached the age of 60 shall be exempt from all meetings and quarterly achievements. As of june 1, 2023 prospectively for new members, only active members of the albertson fire company with a combination of 25 years in the fire service and having reached the age of 60 shall be exempt from all meetings and quarterly achievements. All active members shall be given the opportunity to participate in the length of service award program upon meeting the losap requirements. Only active members in good standing shall have the right to vote on all albertson fire company business. Any member who has served as an active firefighter shall: 1. Be eligible to join the exempt association. 2. And shall upon resigning from the fire company with five (5) years of service shall become an exempt member. Albertson exempt association members shall have the privilege of attending all regular meetings; how-ever they shall have no vote to cast in the elections of officers or propositions. Honorary members, including physicians and chaplains, shall be elected by the members of the fire company. They shall have the privilege of attending all regular meetings; however they shall have no vote to cast in the elections of officers and propositions. They shall serve for a term, which may be terminated at the pleasure of either party. Any active member admitted to the firemen's home in hudson, ny, shall automatically become an honorary and or/ life member as long as they remain a member of the home. Members completing 25 years of active duty will become life members upon their resignation from active service. Life members will have the same privileges as honorary members.

Form 990, Part VI, Section B, Line 11B

Albertson hook & ladder, engine & hose co., has its form 990 prepared by an outside accounting firm and has established the following review process to ensure that the information reported is complete and accurate. When the form 990 has been prepared, and is ready to be filed with the internal revenue service, it is electronically sent to the board of trustees and chief officers for review and approval. Once the trustees and officers have approved the return it is filed with the internal revenue service.

Financial Statement Notes

PART X, LINE 2:

The fire company accounts for the effect of any uncertain tax positions based on a "more-likely-than-not" threshold to the recognition of the tax positions being sustained based on the technical merits of the position under scrutiny by the applicable taxing authority. If a tax position or positions are deemed to result in uncertainties of those positions, the unrecognized tax benefit is estimated based on a "cumulative probability assessment" that aggregates the estimated tax liability for all uncertain tax positions. Interest and penalties assessed, if any, are accrued as income tax expense. The fire company has identified its tax status as a tax exempt entity as a tax position; however, the fire company has determined that such tax position does not result in an uncertainty requiring recognition. The fire company is not currently under examination by any tax jurisdiction. Federal and state information returns are generally open for examination for three years.

THESE SERVICES ARE PROVIDED BY THE VOLUNTEER MEMBERS OF THE FIRE COMPANY.SECONDLY, THE CORPORATION EDUCATES THE GENERAL PUBLIC ON THE IMPORTANCE OF FIRE SAFETY BY HOLDING FIRE PREVENTION SEMINARS IN LOCAL SCHOOLS, AND BY DISTRIBUTING LITERATURE ON FIRE PREVENTION AT VARIOUS COMMUNITY EVENTS. SINCE ITS INCEPTION, THIS HAS BEEN AND WILL CONTINUE TO BE AN IMPORTANT PART OF THE CORPORATION'S GOALS AND OBJECTIVE.
