“Kvcog was gifted twelve pieces of artwork created by artist bernard langlais. The artwork was donated by colby college and the kohler foundation and is made primarily of wood and found materials. Eleven of the twelve pieces were in turn loaned by kvcog to its member municipalities for public display. Each artwork recipient was required to sign a hosting agreement stating the terms and conditions for accepting the artwork to display. The artwork does not have a specified dollar value as it is all one-of-a-kind, and each hosting municipality is required to list the artwork on its comprehensive liability insurance policy.”
“The council is exempt from taxation under section 501(c)(3) of the internal revenue code and is classified as other than a private foundation by the internal revenue service. The council follows the provisions of accounting for uncertainty in income taxes as provided for in the income taxes topic of the fasb accounting standards codification. This statement clarifies the criteria that an individual tax position must satisfy for some or all of the benefits of that position to be recognized in an entity's financial statements. It also prescribes a recognition threshold of more likely-than-not, and a measurement attribute for all tax positions taken or expected to be taken on a tax return, in order for those tax positions to be recognized in the financial statements. There was no cumulative effect on the council's financial statements related to following these provisions, and no interest or penalties related to uncertain tax positions were accrued.
