“The academy's current policy is to draw amounts from its endowment annually for use in furthering its operating activities as well as to provide for certain scholarship payments.”

PART X, LINE 2:

“Lincoln academy is a not-for-profit organization exempt from federal and state income taxes under internal revenue code section 501(c)(3). Accordingly, no provision for income taxes has been made. In addition, donations to the academy qualify for the charitable contribution deduction under internal revenue code section 170(b)(1)(a). The academy has been determined not to be a private foundation within the meaning of section 509(a) of the code. Accounting principles generally accepted in the united states of america requires management to evaluate tax positions taken by the academy and recognize a tax liability if the academy has taken an uncertain tax position that more likely than not would not be sustained upon examination by the internal revenue service and state taxing authorities. The academy is subject to routine audits by taxing jurisdictions; however, there are currently no audits for any tax periods in progress.”
