Financial Statement Notes

PART X, LINE 2:

In june 2006, the financial accounting standards board (fasb) released fasb interpretation (fin) no. 48, accounting for uncertainty in income taxes - an interpretation of fasb statement no. 109. Fin no. 48 is now codified as accounting standards coficication (asc or the "codification") 740, income taxes. Asc provides guidance for how uncertain tax positions should be recognized, measured, presented, and disclosed in the combined financial statements. Asc 740 requires the evaluation of tax positions taken or expected to be taken in the course of preparing the separate account's tax returns to determine whether the tax positions are "more-likely-than-not" of being sustained by the applicable tax authority. Tax positions not deemed to meet the more-likely-than-not threshold would be recorded as a tax benefit or expense in the current period. The separate account adopted asc 740 as of january 1, 2009. Asc 740 requires the separate account to analyze all open tax years. Open tax years are those that are open for examination by the relevant income taxing authority. As of december 31, 2016, open federal and state income tax years include the tax years ended december 31, 2010, through december 31, 2016. The separate account has reviewed all open tax years and major jurisdictions and concluded that the adoption of asc 740 resulted in no effect to the separate account's combined financial position or results of operations.

FIN NO. 48 IS NOW CODIFIED AS ACCOUNTING STANDARDS COFICICATION (ASC OR THE "CODIFICATION") 740, INCOME TAXES. ASC PROVIDES GUIDANCE FOR HOW UNCERTAIN TAX POSITIONS SHOULD BE RECOGNIZED, MEASURED, PRESENTED, AND DISCLOSED IN THE COMBINED FINANCIAL STATEMENTS. ASC 740 REQUIRES THE EVALUATION OF TAX POSITIONS TAKEN OR EXPECTED TO BE TAKEN IN THE COURSE OF PREPARING THE SEPARATE ACCOUNT'S TAX RETURNS TO DETERMINE WHETHER THE TAX POSITIONS ARE "MORE-LIKELY-THAN-NOT" OF BEING SUSTAINED BY THE APPLICABLE TAX AUTHORITY. TAX POSITIONS NOT DEEMED TO MEET THE MORE-LIKELY-THAN-NOT THRESHOLD WOULD BE RECORDED AS A TAX BENEFIT OR EXPENSE IN THE CURRENT PERIOD. THE SEPARATE ACCOUNT ADOPTED ASC 740 AS OF JANUARY 1, 2009. ASC 740 REQUIRES THE SEPARATE ACCOUNT TO ANALYZE ALL OPEN TAX YEARS. OPEN TAX YEARS ARE THOSE THAT ARE OPEN FOR EXAMINATION BY THE RELEVANT INCOME TAXING AUTHORITY. AS OF DECEMBER 31, 2016, OPEN FEDERAL AND STATE INCOME TAX YEARS INCLUDE THE TAX YEARS ENDED DECEMBER 31, 2010, THROUGH DECEMBER 31, 2016. THE SEPARATE ACCOUNT HAS REVIEWED ALL OPEN TAX YEARS AND MAJOR JURISDICTIONS AND CONCLUDED THAT THE ADOPTION OF ASC 740 RESULTED IN NO EFFECT TO THE SEPARATE ACCOUNT'S COMBINED FINANCIAL POSITION OR RESULTS OF OPERATIONS.
