Understands american youth symphony is a non profit and in order to maintain its federal tax exemption, it must engage primarily in activities that accomplish one or more of its tax-exempt purposes.

The policy on the process for reviewing the compensation structure of american youth symphony employees applies to the compensation of the following persons employed by the organization: executive director the process includes all of these elements: (1) review and approval by the board of directors, or executive director (2) use of data as to comparable compensation; and (3) contemporaneous documentation and recordkeeping. 1. Review and approval. The compensation of the person is reviewed and approved by the board of directors, or executive director provided that persons with conflicts of interest with respect to the compensation arrangement at issue are not involved in this review and approval. 2. Use of data as to comparable compensation. The compensation of the person is reviewed and approved using data as to comparable compensation for similarly qualified, persons in functionally comparable positions at similarly situated organizations. 3. Contemporaneous documentation and recordkeeping. There is contemporaneous documentation and recordkeeping with respect to the deliberations and decisions regarding the compensation arrangement.

FORM 990, PART XII, LINE 2C:

The board of directors is responsible for the oversight of the audit, review of the financial statements, and selection of an independent accountant.

Financial Statement Notes

PART V, LINE 4:

The ernst jechart memorial fund (endowment) was established in march 1999 as a permanently restricted endowment fund with an original contribution of $200,000, and matched by a contribution of $100,000 from the hilton foundation on november 17, 2000. The jechart endowment agreement required that the original principal balance of the endowment be increased each fiscal year by the greater of (a) the increase in the consumer price index, or (b) 2.5% and amounts in excess of this balance are available for distribution by ays (requirements). During the year ended june 30, 2014, ays determined that the jechart contribution was too restrictive and returned the $200,000 gift from the donor. The board then approved releasing the accumulated earnings in the permanently restricted portion of the endowment to unrestricted net assets. This resulted in a $100,000 principal balance of permanently restricted net assets. The board of directors of ays has interpreted upmifa as requiring the preservation of the fair value of the original gift as of the gift date of the donor-restricted endowment funds absent explicit donor stipulations to the contrary. The board is aware that there is an implicit understanding that the market value of the donor-restricted endowment may, from time to time, fall below the fair value of the original gift as of the gift date due to market conditions or continued prudent expenditures by the board of certain amounts of the endowment.

PART X, LINE 2:

Ays is a nonprofit organization exempt from income taxes under section 501(c)(3) of the internal revenue code (code). Accordingly, no provision for income taxes is included in the financial statements. In addition, ays has been determined by the internal revenue service not to be a private foundation within the meaning of section 509(a) of the code. Accounting standards require an organization to evaluate its tax positions and provide for a liability for any positions that would not be considered more likely than not to be upheld under a tax authority examination. Management has evaluated its tax positions and has concluded that a provision for a tax liability is not necessary at june 30, 2020 and 2019. Generally, ays information returns remain open for examination three (federal) or four (state of california) years from the date of filing.
