Mission and Program Overview

Mission

LAS-ELCs mission is to advance justice and economic opportunity for poor and low-income people and their families at work, in school, and in the community. We use the full range of legal tools available to ensure all workers are afforded equal and fair treatment per local, state, and federal laws. Our staff and Board believe that work and workplace conditions are critical social determinants of health and work is essential to self-sufficiency, affords dignity, and facilitates civic engagement. LAS-ELC acts on these principles through a variety of strategies, including targeted community outreach and education; innovative partnerships with grassroots and public health entities; helplines; direct services clinics throughout the state; and administrative, court, or other representation. LAS-ELC serves diverse clients, many of whom experience illegal treatment because of their race, ethnicity, national origin, language preference/proficiency, gender, pregnancy, caregiving responsibilities,

Governance Explanations

Form 990, Part VI, Line 1A: Explanation of Delegated Broad Authority to Committee

By resolution on 5/26/11 the Board of Directors ratified and confirmed that it had in the past and continued to delegate authority to the Executive Committee to act on its behalf in all matters except those specified in that resolution. At year-end 2015 the Executive Committee had 27 members.

Form 990, Part VI, Line 11B: Form 990 Review Process

The LAS-ELC 990 is prepared by the auditor, with information provided by the Finance Director and Chief Operating Officer. During the drafting process the 990 isreviewed by the Finance Director, Chief Operating Officer, and President. Uponcompletion of the final draft, the 990 is presented to the Audit Committee of theBoard for review, comment and approval and to the full Board. The Chief OperatingOfficer, Finance Director, and Finance Manager respond to any questions posed by Audit Committee members, and obtain the Committee's approval. The chair of the Audit Committee reports to the Board of Directors at the appropriate quarterly meeting regarding the substance and completion of the 990 filing.

Form 990, Part VI, Line 12C: Explanation of Monitoring and Enforcement of Conflicts

Each director signs the following statement upon election to the Board. Signed statements are kept in the LAS-ELC offices.Adopted by the Board of Directors on July 30, 2009:We, the Directors of the Legal Aid Society Employment Law Center, resolve that no member of the Board of Directors shall participate in any discussion or vote on any matter in which he or she or a member of his or her immediate family has potential conflict of interest due to having material economic involvement regarding the matter being discussed. When such a situation presents itself, the director must announce his or her potential conflict, disqualify him or herself, and be excused from the meeting until discussion is over on the matter involved. The President or Chair of the meeting is expected to make inquiry if such conflict appears to exist and the board member has not made it known.

Form 990, Part VI, Line 15B: Compensation Review and Approval Process for Officers and Key Employees

The LAS-ELC's Compensation Committee is comprised of at least three members of the Board of Directors who are not related to and not subject to the control of the individuals whose compensation the Committee reviews, and who are free of any relationship that would interfere with their exercise of independent judgment as a committee member. The committee annually reviews, approves and recommends to the Executive Committee the annual compensation levels, benefits and retirement programs of the President and other key individuals who are deemed to be Disqualified Persons. In order to establish reasonable compensation levels, the committee engages in the following process: Assesses the nature and scope of each position under its review. Considers factors which might be referenced in setting compensation for each individual in such positions; including for example, exceptional performance, additional duties, unique background, relevant experiences, personal skills, and particular abilities. The committee also considers the business challenges facing the organization that require the use of these or other attributes or skills. Obtains appropriate and comparable compensation market data, including data on the following: compensation of similarly situated organizations, both for-profit and tax-exempt, for functionally comparable positions nature and scope of benefits and retirement programs; the location of the organization; the availability of similar specialists in the geographic area; compensation surveys by recognized independent firms.The Committee documents the basis for its determination of reasonable compensation by including an assessment of the individual's contribution to the LAS-ELC, and the basis for determining that the individual's compensation was reasonable in light of that evaluation and the market data.

IRS990/Desc0LAS-ELCs three largest legal service areas are Direct Services, Enforcement and Impact Litigation, and Outreach and Education.Direct ServicesIn 2015, LAS-ELC provided free legal information and counseling through clinics, helplines, and limited representation to approximately 3,500 indigent and low-income Californians. The Workers Rights Clinic (WRC) is the core of LAS-ELCs direct services offerings; in 2015 the WRC assisted more than 1,200 indigent workers. The WRC is a model program that has inspired other organizations and law schools to establish similar clinical programs. WRC clients are served by approximately 100 law students, 125 volunteer attorneys from the private labor and employment bar, and LAS-ELC staff. Trained student counselors conduct intakes, confer with supervising attorneys to analyze the problems, and then provide clients with information, suggest possible solutions, and make relevant referrals as appropriate. Counselors serve an additional and important function: to inform clients when they do not have legal recourse for their problem, while acknowledging clients expressed feelings that they were not treated fairly. WRCs generally operate weekday evenings in communities with underserved populations throughout California, including: San Francisco's Tenderloin neighborhood, the Berkeley/Oakland border, Fresno, Santa Ana (Orange County), Sacramento/Davis, Watsonville, and East Palo Alto, which was launched in 2015. A new San Diego location will open fall 2016. Workers unable to attend an in-person clinic are assisted via a weekly phone-in WRC. The WRC model relies on volunteers and partnerships with law schools and community organizations. Our WRC partners are: the University of California's Berkeley Law, Davis School of Law, Hastings College of the Law, and Irvine School of Law; Stanford School of Law; the University of the Pacific McGeorge School of Law; and the University of San Diego; as well as East Bay Community Law Center; Central California Legal Services; Legal Aid Society of Orange County; and the Watsonville Law Center, among others. In addition to the WRC, LAS-ELC conducts two specialized clinics: 1.Wage Claim Clinic (WCC): held at San Francisco and Oakland California Labor Commissioner's Office locations. The WCC helps victims of wage theft calculate unpaid wages and complete wage claim forms. In 2015, the WCC assisted 114 workers and represented 62 clients in Labor Commissioner's Office wage claim proceedings. WCC staff facilitated judgments or negotiated settlements totaling nearly $918,000 in recovered wages.2.Workers Rights Disability Law Clinic (WRDLC): held at the Ed Roberts Campus, a universally-accessible transit-oriented disability services hub in Berkeley. WRDLC services are tailored to the needs of clients with disabilities, who receive information, evaluation, advice, and representation when appropriate, on matters regarding reasonable accommodation and disability-based discriminatory treatment or practices. In 2015, the WRDLC clinic assisted 102 people.Also, LAS-ELC operates three helplines:1.Chinese Language Helpline: assisted more than 1,000 monolingual or LEP Cantonese and Mandarin speakers in 2015. 2.Project SURVIVE Helpline: assisted more than 200 survivors of domestic violence, sexual assault, or stalking in 2015. 3.Work & Family Helpline: assisted more than 1,380 pregnant women, new parents, workers with serious health conditions, and caregivers in 2015.Lastly, through limited representation, attorneys assist individual clients with specific matters that might include: requesting personnel files, drafting demand letters, negotiating informal settlements, assisting clients draft and file charges with the Equal Employment Opportunity Commission and Department of Fair Employment and Housing, and representing workers in pre- litigation settlement conferences and mediations.
