Mission

Northwest Advocacy is a charitable organization located in Seattle, WA, Our primary exempt purpose is to provide quality, affordable legal services to indigent, low-, and moderate-income individuals and those experiencing imminent safety issues. Our clients are folks who typically do not qualify for (or cannot wait for) free civil legal aid, but cannot afford a private attorney. We primarily work with (and prioritize) victims of domestic and sexual violence, assisting with protection orders and family law matters. Our legal services program includes consultation (one-time meetings to answer questions and offer advice), pro se assistance (assisting folks to represent themselves), limited representation (representing folks in one aspect of their case, and full representation (handling the entire case) for protection order matters. Our goal is to tailor our services to what each individual needs. We believe that everyone should have access to justice, especially in matters of safety.

Program Services

Our primary program service is to provide quality, affordable legal services to qualifying individuals. In 2020 we were a resource for over 125 people, and provided direct services to over 60 of those people. Without our assistance, the majority of our clients would likely have to represent themselves, navigating an incredibly confusing legal system on their own. Our average hourly rate was 35% of the typical market rate, and we provided 133 hours (the equivalent of $39,900) of pro bono time. We are sustained by donations, and in 2020 we raised over $30,000. These donations enabled us to charge clients a reduced hourly rate. In 2020, in response to the increased need for civil legal aid, we also partnered with a local nonprofit with a similar mission, Eastside Legal Assistance Program (ELAP). ELAP screened in-need folks, partnered them with attorneys, and, using CARES funding, paid a reduced hourly rate ($100) to participating attorneys. In just three months, we provided over 60 hours of legal services to six families.$0$143,469

ReasonableCauseExplanation/ExplanationTxt0In early 2023, we received a letter from the IRS stating that our 2020 Form 990-EZ was returned. We responded to the letter as instructed, but did not hear back. We continued to check the IRS website, which continued to say that processing times were delayed. When we most recently checked today, we saw that our 2021 return had now posted, but the 2020 return is still not showing. I spoke with an IRS employee (ID 1003381685) who advised that I file an amended return. As we explained in our January 2023 letter: The IRS letter stated that our 2020 Form 990-EZ was returned because we either didn't provide or didn't complete Schedule B. We did not submit a Schedule B because we did not receive $5,000 or more from any contributor. I have carefully reviewed our submission, and I believe the error is that Box H is not checked, and so the IRS expected to receive a Schedule B with our Form 990-EZ. Though this box is checked in the electronic version, that somehow did not transfer when I printed and mailed the return, and I failed to notice it. I deeply apologize for this mistake. The IRS letter further explains that the law provides a penalty of $20 per day, with a maximum penalty as much as $10,000, and that we may want to provide a reasonable cause explanation of why we did not initially submit all of the required information. As explained above, we did provide all of the required information, though I understand that my failure to check Box H resulted in me submitting an incomplete return, so I assume the penalties still apply. I am not typically one for excuses, but I would like to explain, and beg for your mercy in either waiving this penalty, or, if you believe a penalty is warranted, assessing it at the lowest amount you find reasonable. Below are the facts that support this request: 1.As soon as we received this letter, we worked to respond to it. We received your mail on January 19, 2023. We immediately reviewed it and began researching what happened. By 12:00pm on January 20, 2023, we had responded to the iRS letter via fax and mail, in an attempt to address this issue expeditiously. 2. This was not due to carelessness. We spend substantial time each year filling out our Form 990-EZ. This is not a responsibility we take lightly - we review everything multiple times, in order to ensure that everything is correct. Five different people reviewed this document no less than three times each. But we all reviewed it on our computers, where Box H was checked. This was simply an unfortunate technology mishap. Still, I recognize that I should have reviewed it again after it was printed. 3. A fine could harm our organization. We are a two-woman operation (plus three directors) providing legal services to low-income victims of domestic violence, child abuse, and sexual assault. A $10,000 penalty would harm our organization significantly. 4.A daily fine would be unfair. Assessing a daily penalty from any date prior to January 3, 2023, would be unfair. We submitted our 2020 Form 990-EZ on May 1, 2021. Your first letter about this issue, dated April 6, 2022, was sent to the address included on our 2020 tax return. However, over three months earlier, we had updated our address with you. By February of 2022, we had received mail at the new address from you, confirming that you had our new address. (See attached: (a) Change of Address form, mailed to the IRS on 12/22/2021; (b) Letter from the IRS, to our new address, dated 02/14/2022; and (c) Letter from the IRS, to our new address, dated 02/16/2022.) Further, though your April letter was returned to you the following week, it was not mailed to our new address until January 3, 2023, almost nine months later. As such, assessing a late penalty beginning on April 6, 2022, would be unfair, as we had not received the letter, due to no fault of our own.
