“A member on the board of directors is related to the Executive Director”
“The Form 990 is professionally prepared and then reviewed by the Executive Director and staff. The Form 990 is then sent to the Board of Directors for review and approval. Once approved the return is finalized and submitted.”
“Monitoring and enforcing compliance with Conflict of Interest Policy regularly take place. In the process of recruiting new board members, each prospective candidate is provided a copy of the policy along with the board approved code of ethics. The standards and requirements contained in these documents are discussed during the candidate interview. The Conflict of Interest is raised if business conducted at board or committee meeting involves or could involve a conflict of interest. If it is found present the person affected must exercise recusal and return to the meeting only after the matter at hand has been dispensed. The process of reviewing and evaluating grant applications from local 501(c)(3) nonprofits give special attention to conflict of interest requirements. Members of the grant panels are routinely advised of such requirements and are obligated to recuse themselves if a conflict arises that applies to them”
“Governing documents and IRS filings are made available to the public upon request. The process is such that when a request is made the Executive Director will sign off on it and the requestor will pick up the copy. All information is kept in a log.”
“The Trust follows the guidance of the Financial Accounting Standards Board Accounting Standards Codification 740-10, Accounting for Uncertainty in Income Taxes which clarifies the accounting for the recognition and measurement of the benefits of individual tax positions in the financial statements, including those of non-profit organizations. Tax positions must meet a recognition threshold of more-likely-than-not in order for the benefit of those tax positions to be recognized in the financial statements. The Trust analyzes tax position taken, including those related to the requirements set forth in IRC Section 501(c) to qualify as a tax-exempt organization, activities performed by volunteers and board members, the reporting of unrelated business income, and its status as a tax-exempt organization under Maryland statute. The Trust does not know of any tax benefits arising from uncertain tax positions and there was no effect on the Trust's financial position or changes in net assets as a result of analyzing its tax positions. The Trust's Form 990 remains open for three (3) years, for examination from the later of the due date or the date filed.”

Tax positions must meet a recognition threshold of more-likely-than-not in order for the benefit of those tax positions to be recognized in the financial statements. The Trust analyzes tax position taken, including those related to the requirements set forth in IRC Section 501(c) to qualify as a tax-exempt organization, activities performed by volunteers and board members, the reporting of unrelated business income, and its status as a tax-exempt organization under Maryland statute. The Trust does not know of any tax benefits arising from uncertain tax positions and there was no effect on the Trust's financial position or changes in net assets as a result of analyzing its tax positions. The Trust's Form 990 remains open for three (3) years, for examination from the later of the due date or the date filed. |
