“The symphony is a not-for-profit organization that is exempt from federal income taxes under section 501(c)(3) of the internal revenue code (irc) as a charitable organization whereby only unrelated business income, as defined by section 509(a)(1) of the irc, is subject to federal income tax. The symphony has no unrelated business income for the years ended may 31, 2025 and 2024. The symphony evaluates its uncertain tax positions in accordance with fasb asc 740, income taxes, which states that management's determination of the taxable status of an entity, including its status as a tax-exempt not-for-profit entity, is a tax position subject to the standards required for accounting for uncertainty in income taxes. Management does not believe that the symphony has any significant uncertain tax positions that would be material to the financial statements. The symphony's tax returns for tax years prior to 2022 are no longer subject to examination by the internal revenue service.”
