“The fauquier hospital endowment fund (the trust) is an irrevocable trust created by the chichester dupont foundation in 1959. “The following is the text of the footnote to the organization's consolidated financial statements. In the footnote, fhs services refers to the consolidated group as a whole which includes fhs services,fhi services, and fauquier health foundation. Fhs services, fhi services and the fauquier health foundation (d/b/a path foundation) are all exempt from federal income tax under section 501(c)(3) of the internal revenue code as a public charity pursuant to irc section 509(a). Federal tax law requires that these entities be operated in a manner consistent with their initial exemption application to maintain their exempt status. Management has analyzed the operations of these entities and concluded that these entities remain in compliance with the requirements for exemption. The state in which these entities operate also provides a general exception from state income taxation for organizations that are exempt from federal income taxation. However, these entities are subject to both federal and state income taxation at corporate tax rates on their unrelated business income. These entities have no unrecognized tax benefits. Management has also considered the impact of unrelated business activities and has concluded that these entities are not subject to unrelated business tax or any other taxes that could be imposed by the irc or state taxing authorities. As such, no provision is made for income taxes and no asset or liability has been recognized for deferred taxes.”
