“The center and the fund are not-for-profit organizations exempt from federal income taxes under section 501(c)(3) of the internal revenue code and is recognized as such by the internal revenue services. Bcpif and cde are limited liability corporations and pass through entities for income tax purposes and thus these entities do not pay income taxes but instead their profits are passed through to its owners to be taxed. The provisions included in accounting principles generally accepted in the united states of america provide consistent guidance for the accounting for uncertainty in income taxes recognized in an entity's financial statements and prescribe a threshold of "more likely than not" for recognition of tax positions taken or expected to be taken in a tax return. The center performed an evaluation of uncertain tax positions as of december 31, 2024, and determined that there were no matters that would require recognition in the financial statements or, which may have any effect on its tax-exempt status. As of december 31, 2024, the statute of limitations for tax years 2021 through 2024 remains open with the u.s. Federal jurisdiction or the various states and local jurisdictions in which the center files tax returns. It is the center's policy to recognize interest and/or penalties related to uncertain tax positions, if any, in income tax expense.”
