Board members are required to complete a conflict of interest disclosure form on an annual basis. The questionnaire focuses on essential information and affiliations provided by a board member to assist in identifying whether a conflict exists and to ensure the board member has the necessary remediation of that conflict and act in the best interest of naswa. Naswa has a structured conflict of interest process, which includes the following steps: (1) identification of the financial, business or personal interest in conflict with naswa interest; (2) disclosure of the conflict to the president of the board, executive director, and executive committee of the board; and (3) discussion of any impact on naswa and possible remedial actions or mitigations withe legal counsel, if necessary. Remedial actions may include the creation of firewalls in the board member's work, recusal from a business decision or transaction involving naswa or the other organization, withdrawal from the other organization's business, and/or other actions that eliminate the conflict of interest or appearance of a conflict. In addition to the board of directors, all naswa staff are required to complete an annual conflict of interest form. The personnel department distributes and oversees the completion of the conflict of interest forms by employees. The executive team oversees the completion of these forms by the board members.

Employees' salaries are reviewed annually and must have worked for the organization for at least 90 days to be eligible for an increase. Salary increases are measured against staff performance. Any increases recommended for staff are reviewed by the president and the executive team. Any yearly adjustment becomes part of the base salary of the employee and will be paid at an annualized rate. Compensation for the president is reviewed annually by the board's executive committee and any adjustment becomes part of the base salary. The organization reviews compensation details that are available on similar sized non-profit companies to align with current market conditions.

Financial Statement Notes

PART IV, LINE 2B:

America's job link alliance-technical support (ajla) functions as a national field center to provide services for financially participating agencies within the federal/state employment security system. The organization collects and disburses custodial funds at the direction of the kansas department of commerce (kdc), which administers ajla. The organization exercises certain oversight authority over ajla and incurs expense in fulfilling this obligation and for maintaining its custodial responsibilities for amounts received and disbursed.

PART X, LINE 2:

The organization is exempt from federal and state income taxes under section 501(c)(4) of the internal revenue code except on activities unrelated to its exempt purpose. Income that is not related to exempt purposes, less applicable deductions, is subject to federal and state corporate income taxes. The organization had no unrelated business income for the years ended september 30, 2024 and 2023; accordingly, no provision for income taxes is reflected in these consolidated financial statements. The organization's federal exempt organization returns are subject to examination by the internal revenue service, generally for a period of 3 years after the returns are filed.
