A full copy of the form 990 will be provided to the board chair and audit committe chair beofre filing. The entire board will receive a public copy of the return following the sumbission of the form.

Form 990, Part VI, Section B, Line 12C

The policy pertains to all employees and board members. Every year each full time employee and each board member is required to fill out a new conflict of interest statement. If they believe a conflict exists, they must report it to the president/ceo. If the president believes a conflict exists he will decide what steps to take to eliminate the conflict. The organization holds an annual meeting with the staff to discuss the conflict of interest policy, what is expected from staff, and examples of possible conflicts.

The organization uses market benchmarking for determining all wages and salaries of all full time and part time positions. Wherever possible the organization will find local, state, or national salary surveys to use as comparables for all full time and most part time positions. Typically 3 to 8 different surveys are included in the benchmarking. In addition, the center engages a third party to compile benchmarking for the president and ceo, and vice president positions. The executive committee reviews benchmarking and approves any changes. The process described here was last completed in 2024.

The organization's artwork collections are on public display in the common areas of the performing arts center. The art furthers the marcus center's charitable purpose of advocacy of the arts in milwaukee.

The organization is exempt from federal income tax under section 501(c)(3) of the internal revenue code. In addition, the organization qualifies for the charitable contribution deduction under section 170(b)(1)(a) and has been classified as an organization other than a private foundation under section 509(a)(2). The organization is also exempt from wisconsin income taxes. The organization may be liable for taxes on unrelated business income but has not paid such taxes to date.
