Governance Explanations

Form 990, Part VI, Section A, Line 6

Members of the local workforce development board shall be appointed by the kansas workforce investment act area i leo board. Accordingly, membership shall be representative of the general population of the kansas workforce investment act area i, including representatives of private business, industry, education and representatives of local and state public entities. Appointments shall be for staggered three (3) year terms beginning on july 1, with approximately one-third (1/3) of the membership's terms expiring each year. Appointments are subject to prior resignation or removal. A majority of the membership shall be comprised of representatives of business.

Under the workforce investment act, a board of local elected officials has the responsibility to accept nominations of prospective board members from representative organizations, and the authority to appoint all members of the board during meetings of the local elected officials board.

Form 990, Part VI, Section A, Line 7B

The local elected official board has the responsibility to approve and/or ratify certain decisions made by the local area i workforce development board. Some of these decisions and duties include developing a five-year local workforce investment plan, negotiate with the state of kansas workforce investment act program performance standards, appoint a youth council, select youth service contractors, and award service delivery contracts.

A local workforce development board member shall declare a conflict of interest, refrain from entering into the discussion of the matter as a local area workforce development board member and not cast a vote on any matter which has a direct bearing on services to be provided by, or authority or responsibility to be imposed upon, that member or any employer of such member or organization which that member directly represents, or on any matter which would financially benefit such member, an immediate family member of such member or any employer of such member or organization such member represents. In the event a local workforce development board member fails to comply with these conflicts of interest provisions, the chairperson of the local workforce development board may, upon reasonable belief of a local workforce development board member's conflict of interest, bar the member from the discussion and vote on the matter.

Form 990, Part VI, Section B, Line 15

On an annual basis (june of each year) the executive director presents a budget including proposals for wages and benefits for administrative and program staff to the executive committee which has the responsibility to act on personnel issues on behalf of the board. The administrative budget has received prior approval by the entire local workforce development board. Personnel wages and benefits are determined by a review of comparable salaries and benefits in the surrounding labor market; prior years achievement of performance standards; efficient administration of dollars available for program delivery including numbers served; and annual audit results. Final budget line items must then be approved by the local elected official board.

Financial Statement Notes

PART X, LINE 2:

Income taxes the organization is a nonprofit organization under section 501(c)(3) of the internal revenue code and is exempt from federal and kansas income taxes. The organization is required to assess whether it is more likely than not that a tax position will be sustained upon examination of the technical merits or the position, assuming the taxing authority has full knowledge of all information. If the tax position does not meet the more likely than not recognition threshold, the benefit of the tax position is not recognized in the financial statements. The organization has determined there are no amounts to record as assets or liabilities related to uncertain tax positions.
