Financial Statement Notes

Pt X, Line 2

The organization has adopted "accounting for uncertainty in income taxes" as prescribed by the accounting standards codification which provides guidance for financial statement recognition and measurement of uncertain tax positions taken or expected to be taken in a tax return for open tax years (generally a period of three years from the later of each return's due date or the date filed) that remains subject to examination by the organization's major tax jurisdictions. Generally, the organization is no longer subject to income tax examinations by major taxing authorities for years ending after december 31, 2017. In accordance with "accounting for uncertainty in income taxes", the organization asssesses its tax positions and determines whether it has any material unrecognized liabilities for uncertain tax positions. The organization records these liabilities, when and if applicable, to the extent it deems them more likely than not to be incurred. Interest and penalties related to uncertain tax positions, if any, would be classified as a component of income tax expense. Accordingly, no such loss contingencies have been recorded for the year ended december 31, 2020, as the organization believes that it does not have any significant uncertain tax positions requiring recognition or measurement in the accompanying financial statements.

IRS990ScheduleA/Form990ScheduleAPartVIGrp/ExplanationTxt0In accordance with Treasury Regulation Section 1.170A-9(f)3, Energy Innovation Reform Project (EIRP)(the Organization) is publicly supported because it normally receives a substantial part of its support directly from the general public including individuals and other public charities, and is organized and operated to attract public support. The Organization has been in existence for only nine years and has focused its initial efforts on becoming a thought leader in the energy innovation sector. This has required large research grants that are best obtained from private foundations, which has resulted in the Organization's failure to satisfy the 33-1/3% test. However, the Organization applies to a broad group of private foundations while also seeking government grants, grants from other publicly supported organizations and the general public. As a result the Organization typically receives approximately 25% of its support from the general public. During 2020, 2021 and 2022, the Organization has successfully won grants from several new donors even through the adverse and economic effects of COVID. EIRP is also publicly supported because it works with a diverse group of experts and members of the public in developing solutions to matters of broad public interest -- namely, clean and renewable energy -- and makes the results of these efforts available to the general public. EIRP conducts working group meetintgs that feature subject matter experts and members of the public from a diverse population of stakeholders in the energy industry including: 1.) Industry leading scientists and researchers working in Nuclear, Renewables and Fossil Fuel energy sectors; 2.) Power Producer leaders; 3.) Corporate representatives of integrated energy component producing organizations; 4.) Regulator representatives; 5.) Organized labor representatives; and 6.) Publicly supported charitable organizations. EIRP makes the results of the research and analysis conducted by these working groups available for the benefit of the general public by conducting educational outreach seminars and small group meetings with members of Congress and other government representatives and publishing reports and white papers that are broadly disseminated to stakeholders and made available to the general public on the Organization's website. Finally, the Organization has a governing body that represents the broad interests of the public, including representatives from academia, a foreign policy expert and former diplomat, an executive of a leading energy technology public-company, executives of other charitable organizations, and energy policy and technology thought leaders. It should be noted that the Covid-19 pandemic hampered progress in the ability to conduct outreach to new donors due to limitation of in person contact (face to face meeting with prospective donors), that general resources have been redirected by contributors to other human necessities such as housing and food, and that as a result of the pandemic there was a general economic uncertainty which impacted donor giving.
