The Coordinator (equivalent of Executive Director) along with the Treasurer or another designated officer reviews form 990 after preparation. Staff circulates it to the full governing body prior to filing when possible or immediately after filing otherwise.

Form 990, Part VI, Section B, Line 12C

Following the organization's COI policy, governing body members must annually review the COI policy, sign that they comprehend and will abide by it, and disclose any potential conflicts of interest that exist at the time of their appointment or as new potential conflicts may arise, at minimum annually. Other members then evaluate potential conflicts in closed session with the potentially conflicted member(s) absent. If members discover an undisclosed potential conflict, they follow the response procedures outlined in the policy. The policy applies to governing body members and employees. Determinations of whether a conflict exists is made by the governing body as a whole and persons with a COI may not participate in deliberations/votes to which their conflict applies.

During the entirety of FY21-22, TCWC contracted with the New York State Department of Labor to provide education and awareness to targeted populations about their potential qualification for available pandemic emergency funds for low wage earners who lost more than 50% of their wages and did not otherwise qualify for Unemployment Insurance or Pandemic Unemployment Assistance. This program is described in greater detail below under Program Service Accomplishments, Part III, Line 4D.

By far, the bulk of our expenses for outside services was for our sub-contract with the Midstate Education and Services Foundation in carrying out our pandemic era Excluded Workers Fund Program ($40,450). Additional outside services for which we contracted were Quickbooks Enhanced Payroll services ($920), grant writing and reporting assistance ($2,512), new database consultation and development ($670), meeting facilitation ($1,000), mediation services ($500), religious institutions outreach ($369), and junk clean out/disposal and moving assistance (690).

IRS990/Desc0The Community Worker Organizing Program provides resources for workers as they develop, share and exercise skills to engage in workplace concerted actions or other good faith actions to improve the terms and conditions of employment for themselves and for others. The Workers' Center seeks to empower people who wish to "renegotiate the social contract" in ways that build cultures of respect and reasonable compensation in exchange for their labor. When we're contacted by someone who wants to organize with others in their workplace, we provide information, guidance, support and encouragement to assist them in accomplishing their goals. The Workers' Center also works with local and regional labor unions to promote community awareness of workers' rights to democratic determination around collective bargaining and to influence employers to respect union members' rights. The Workers' Center's physical offices are a shared work and meeting space for other small non-profits and social justice oriented associations. Due to the ongoing Covid pandemic, we instituted and enforced strict safety guidelines for staff/sub-lessors who needed to come into the office when they were unable to work or meet remotely. To ensure the health and safety of staff, sub-lessors, other groups and clients seeking our services, we continued our organizing work remotely through phone and virtual meetings as much as possible.

IRS990/ProgSrvcAccomActy2Grp/Desc0The Living Wage Advocacy Program educates the public about the cost of living and the challenge to self-sufficiency that low wage earners face without a living wage. This program promotes development of a social contract that all working people deserve a livable wage in exchange for their labor. Our certified Living Wage Employer Program recognizes any enterprise that voluntarily pays all employees at least a living wage. The living wage for Tompkins County, where TCWC is located, increased during our FY21-22. Consequently some previous LW employers were unable to increase wages at the time and lost their certified status. However, we did certify 12 new living wage employers between 7/1/2021 to 6/30/2022. As of 6/30/2022, 122 government, non-profit and for-profit employers had earned certification. We have been ongoingly engaged in a campaign to increase the local minimum wage to a living wage.

Due to the Covid pandemic, we continued to provide our Hotline services primarily by phone and video meetings. Most users of the Hotline are residents of Tompkins County, NY, and the surrounding Fingerlakes and Southern Tier regions. Worker Advocates for the Hotline educate workers about their rights at work and organizing or communication skills that help users become better advocates for themselves or others, with an emphasis on building a workforce with greater self agency and knowledge of rights. The Workers' Center may act as a mediator to help resolve conflicts or help workers prepare complaints to regulatory agencies when necessary. Hotline Advocates encourage concerted action between co-workers whenever possible and may provide informational resources and help coordinate community support when workers' seek to organize a union. The Hotline served 312 people between 7/1/2021 - 6/30/2022.

IRS990/ProgSrvcAccomActyOtherGrp/Desc0The Excluded Workers Fund Program, funded by the New York State Department of Labor, was a year long program to provide education and awareness to targeted populations who could be candidates for for this specialized pandemic era program. We sought out and worked with people in the targeted demographic to inform them about their potential qualification for pandemic emergency funds available to those who did not qualify for Unemployment Insurance or Pandemic Unemployment Assistance, were low wage earners making less than $27,000 and lost more than 50% of their wages due to the pandemic. Staff provided accessibility and application support, including language translation, for over 200 workers to apply for funding from the Excluded Workers Fund. In order to broaden our reach throughout an eight-county region in New York State's Finger Lakes and Southerntier, we sub-contracted with the Midstate Education and Service Foundation, another 501(c)3 organization who already had, or was in the position to develop, relationships with targeted populations, particularly immigrant and/or Spanish-speaking farm workers.
IRS990/ProgSrvcAccomActyOtherGrp/Desc1Tompkins County Workers' Center contracts with two small charitable organizations, Mutual Aid Tompkins and the Tompkins County Immigrant Rights Coalition, who do not have their own 501(c)3 designation and need a fiscal sponsor in order to solicit and receive tax deductible contributions for their work. We accept donations and/or grants to support the mission and activities of the organizations we sponsor, maintain those funds in separate savings accounts and record them in restricted accounts in our accounting system. The organizations may request a payout of funds on a monthly (or longer) basis by submitting a written request specifying the amount they would like to receive up to the amount available and stating how the funds are to be used. As long as the request is consistent with charitable purposes, supports their mission and adheres to any donor restrictions, we issue a payment in the form of a grant. TCWC charges an administrative fee for these services. Each fiscally sponsored organization is required to submit, at minimum, an annual report listing the funds received, how the funds were spent and program accomplishments which is then reviewed by staff for compliance. The cumulative amount of money distributed between 7/1/2021 and 6/30/2022 was $7,576; however, neither organization received $5,000 or more during this period and so were not required to be reported separately on Schedule I.
