Governance Explanations

Form 990, Part VI, Section A, Line 1

The department executive committee shall consist of the department elected officers, the immediate past department commander and treasurer (who is the appointed chairman of the finance committee). The department adjutant, or designee, shall serve as secretary to all executive committee meetings. As appointed officers, the department adjutant and treasurer shall participate in all executive committee meetings as ex officio advisory members without vote. The executive committee may exercise such power specifically granted a state department executive committee by the terms of the constitution and bylaws of the national organization now existing or thereafter amended, except such powers as may be expressly withheld, limited by or inconsistent with the national constitution and bylaws, these bylaws, or any mandate of the last preceding department convention.

Any man or woman, who was wounded, gassed, injured or disabled in line of duty during time of war, while in the service of either the military or naval forces of the united states of america, and who has not been dishonorably discharged or separated from such service, or who may still be in active service in the armed forces of the united states of america as allies during any of its war periods, who are american citizens and who are honorably discharged, are also eligible.

Membership membership is the lifeblood of dav, and dav's community of heroes stand together to ensure our nation keeps its promises to the men and women who served. This steadfast dedication to our cause has made dav what it is today-a premier organization made up of veterans serving veterans. Dav was founded after world war i-before there existed a centralized structure to support veterans wounded or made ill in the trenches. America was not prepared for their return, and something needed to be done. Minnesota is 30 dav chapters across mn that makes up our 19,000 plus membership for our organization.

Financial Statement Notes

PART X, LINE 2:

The department is exempt from federal taxation under section 501(c)(4) of the internal revenue code (the code) though it would be subject to tax on income unrelated to its exempt purposes, unless that income is otherwise excluded from taxation by the code. The tax years ended june 30, 2015, 2016, and 2017 remain open to audit for both federal and state of minnesota puropses. The department maintains tax-exempt status in minnesota under chapter 317a of the minnesota statutes. Contributions to the organization are tax-deductible to donors under section 170 of the code. The department is not classified as a private foundation.

THE ORGANIZATION RECEIVES DONATIONS OF USED CLOTHING AND HOUSEHOLD GOODS AND SELLS THESE ITEMS TO TVI AT A CONTRACTED PRICE BASED ON A CONTRACTED RATE PER POUND OF BULK GOODS. THE ORGANIZATION RECEIVES DONATED GOODS THROUGH TWO SEPARATE COLLECTION METHODS: (1) THE ORGANIZATION SOLICITS THE PUBLIC DIRECTLY AND COLLECTS AND DELIVERS GOODS UTILIZING THE ORGANIZATION'S OWN EMPLOYEES AND EQUIPMENT. THESE ITEMS ARE THEN DELIVERED TO TVI LOCATIONS FOR BULK PURCHASE. (2) TVI LOCATIONS ARE ALSO COLLECTION SITES FOR GOODS RECEIVED DIRECTLY FROM THE PUBLIC WHERE THE ITEMS ARE CONSIDERED TO BE PURCHASED BY TVI AT THE TIME OF THE DONATION. THE ORGANIZATION DOES NOT INCUR A DIRECT PROFESSIONAL FUNDRAISING EXPENSE FOR EITHER COLLECTION METHOD AS NO PAYMENT IS MADE FROM THE ORGANIZATION TO TVI. TVI'S RIGHT TO PURCHASE THE DONATED ITEMS IS REQUIRED BY THE CONTRACT. THE RESULTING ACTIVITY IS REPORTED IN FORM 990, PART VIII, LINES 10A-10C. THE AMOUNT REPORTED IN COLUMN (IV) REPRESENTS THE ESTIMATED FAIR MARKET VALUE AS REPORTED TO THE ORGANIZATION FROM TVI AS THE RETAIL SALES PRICE OF THE DONATED GOODS IN TVI'S RETAIL STORES. THE AMOUNT IN COLUMN (V) INCLUDES THE ESTIMATED COST OF THE SOLICITATION CAMPAIGN (PROFESSIONAL FUNDRAISING SERVICES) AS WELL AS TVI'S COSTS OF OPERATING THE RETAIL LOCATIONS WHERE THE BULK GOODS ARE SORTED, PROCESSED FOR SALE AND SOLD. THE CONTRACT DOES NOT SPECIFICALLY DISTINGUISH PAYMENTS FOR PROFESSIONAL FUNDRAISING SERVICES FROM EXPENSE PAYMENTS, THEREFORE, THE ENTIRE AMOUNT RETAINED BY TVI IS REPORTED. THE ACTUAL PAYMENTS RECEIVED BY THE ORGANIZATION FROM TVI FOR THE SALE OF THE BULK GOODS IS REPORTED AS THE NET AMOUNT IN COLUMN (VI).
