The two employer representative board members do not have voting rights to vote on budget and operating expenses of the pool. They can vote on all other matters.

The wisconsin compensation rating bureau ("bureau") acts as trustee for the wisconsin worker's compensation insurance pool ("pool"). The wcrb governing board is given complete charge and management of the affairs of the bureau under the authority of article vii of the bureau bylaws. The governing board consists of five stock and five non stock insurer representatives elected by members of the bureau; and two employer representatives elected by the governor.

The wwcip operates under the statutes of the state of wisconsin 2019-2020, which provides, in part, as follows: 619.01 mandatory risk-sharing plans insurance of rejected workmen's compensation risks as provided by the wisconsin administrative code. (1) mandatory plans (a)establishment of plans. - if the commissioner finds after a hearing that in any part of this state, worker's compensation insurance, is not readily available in the voluntary market, and that the public interest requires that availability, the commissioner may by rule either promulgate plans to provide such insurance coverages for any risks in this state that are equitably entitled to, but otherwise unable to obtain, that coverage, or may call upon the insurance industry to prepare plans for the commissioner's approval. (b)purposes and contents of risk-sharing plans. The plan promulgated or prepared under par. (a) shall: 1. Give consideration to the need for adequate and readily accessible coverage, to alternative methods of improving the market affected, to the preferences of the insurers and agents, to the inherent limitations of the insurance mechanism, to the need for reasonable underwriting standards, and to the requirement of reasonable loss prevention measures; 2. Establish procedures that will create minimum interference with the voluntary market; 3. Spread the burden imposed by the facility equitably and efficiently within the industry; and 4. Establish procedures for applicants and participants to have grievances reviewed by an impartial body.

The amount declared and to be distributed for 2022 to bring the net assets down to the aggregate estimated values of such claims was $28,220,904.

Administrative services are provided to the wisconsin worker's compensation insurance pool (wwcip) by the wisconsin compensation rating bureau (bureau). Since the administration of the pool by the bureau is provided for by the statutes of the state of wisconsin, the pool does not reimburse the bureau.

Financial Statement Notes

PART X, LINE 2:

The wisconsin workers' compensation insurance pool (pool) is exempt from united states income taxes as provided by section 501(c)(6) of the internal revenue code. The pool is exempt from wisconsin income taxes. Under generally accepted accounting principles, management is required to evaluate any uncertain tax positions taken, if any, and provide additional disclosures. At this time, the pool does not believe it has taken any uncertain tax positions that may have a material effect on its financial statements or note disclosures.
