The organization is a craft union consisting of more than 52,000 active and retired members.

Form 990, Page 6, Part VI, Line 7A

To be eligible to vote in the election of national division officers, a member in good standing must have his/her dues paid up through the month prior to the month in which the election is held. The officers of the national division shall be elected from the membership by direct membership voting and shall be the national president, first vice-president, who will be the alternate national president, national secretary-treasurer, and eight vice presidents, one of which shall be the national legislative representative. These officers collectively shall constitue the advisory board.

The local chapters which are identified as divisions are subject to the current bylaws in effect until the next convention which convenes in 2014.

The advisory board shall employ a firm of certified public accountants to audit the books of all departments of the blet annually; such audit to show all moneys received from and what source and the amount paid out and for what purpose. Upon completion of the audit a report shall be made to the advisory board of the results of the audit. After which the annual 990 organization exempt from income tax return shall be prepared and reviewed by the national secretary-treasurer and national president.

The future leadership of the organization is out among the membership therefore the national president attends town hall meetings to interact with the brothers and sisters to encourage, educate and assist. These young brothers and sisters are steadily gaining the experience and wisdom necessary to take the throttle of leadership and power the brotherhood into the next century. His part in their advancement he addresses with enthusiasm and pleasure to help nourish the growth of the future strength, and to recognize the contributions of the generation of members that are reaching retirement age.

The brotherhood is a not-for-profit organization and has been recognized as tax-exempt pursuant to section 501(c)(5) of the internal revenue code. In accordance with the "income taxes" topic of the fasb asc, uncertain income tax positions are evaluated at least annually by management. The brotherhood classifies interest and penalties related to income tax matters as income tax expense in the accompanying statements of revenue and expenses - modified cash basis. As of december 31, 2013 and 2012, the brotherhood has identified no uncertain income tax positions and has incurred no amounts for income tax penalities and interest for the years then ended. The brotherhood files its federal form 990 in the u.s. Federal jurisdiction. The brotherhood believes it is no longer subject to examination by the internal revenue service for calendar years before 2010.

WORKING JOINTLY WITH SMART TRANSPORTATION DIVISION (FORMER UTU), WE SUCCESSFULLY LOBBIED CONGRESS TO INTRODUCE SWEEPING LEGISLATION THAT WOULD MANDATE BY FEDERAL LAW THAT TWO QUALIFIED INDIVIDUALS ARE IN THE CAB OF EACH FREIGHT TRAIN OPERATING IN THE UNITED STATES.

THE BROTHERHOOD FILES ITS FEDERAL FORM 990 IN THE U.S. FEDERAL JURISDICTION. THE BROTHERHOOD BELIEVES IT IS NO LONGER SUBJECT TO EXAMINATION BY THE INTERNAL REVENUE SERVICE FOR CALENDAR YEARS BEFORE 2010.
