“In july 2016, sdvlp established the board-designated quasi-endowment fund (the "fund"). The purpose of the fund is to ensure the stability of the mission, programs, employment, and ongoing operations of the organization. The fund is intended to provide an ongoing and consistent source of funding to support sdvlp programs and general operating expenses. The fund may also be used for one-time, nonrecurring replenishment of the sdvlp operating reserve, if approved by the board of directors. The fund will be maintained in segregated accounts and not commingled with the general cash and investment accounts of sdvlp. The fund will be funded with surplus operating funds without donor restriction, or a specific source of revenue set aside for the fund. Examples may include one-time gifts or bequests, cy pres awards, special grants, or special appeals. The fund is invested in accordance with the sdvlp investment policy statement. As stated above, the primary objective of the fund is to provide additional financial support for the mission of sdvlp. Annual interest and dividends generated by the fund shall be accumulated each fiscal year in a separate money market account. When preparing the proposed annual budget for approval by the board of directors, the chief executive officer will include a line item earmarked to be spent using the previous year's accumulated earnings on specific sdvlp programs or infrastructure needs.”

“Sdvlp is a public charity and is exempt from income taxes under section 501(c)(3) of the internal revenue code and section 23701(d) of the california revenue and taxation code. Sdvlp believes that it has appropriate support for any tax positions taken, and, as such, does not have any uncertain tax positions that are material to the financial statements. Sdvlp has been determined not to be a private foundation under irc sections 509(a)(1) and (3). Sdvlp is required to file a return of organization exempt from income tax (form 990) with the irs. In addition, sdvlp is subject to income tax on net income that is derived from business activities that are unrelated to their exempt purposes. Sdvlp has determined it is not subject to unrelated business income tax and has not filed an exempt organization business income tax return (form 990-t) with the irs.”
